uncovered back. 5_ If the Jury believe the plff signed the Bond as is shown in the proof, and that upon its execution the Sheriff in consideration thereof delivered over the property levied upon to said English and? if said English as well as said plff failed to deliver said prop= erty in satisfaction of said judgment ? said ? according to the condition of said Bond and if they further find that at the ? of said plff an execution ? against said English Plaintiff Nabors and the said Nabors told the plain= tiffs against that he would pay him $100 in sat= isfaction of the whole claim and that if he refused to take this proposition up, he would avoid the bond by further letigation and the said plff by his said agent ? to the proposition of said tabors? and recieved $100. and entered sat= isfaction in full of the debt and damages of ucord as showup by the record, the plff cannot recover_
