Sanderson Esq., attorney for the defendants. Charles Crocker along with Leland Stanford, Collis Potter Huntington and Mark Hopkins built the Central Pacific Railroad. Crocker was the Construction Supervisor for the Central Pacific Railroad.

Q 28 Were you a director and officer of the corporation known as the San Francisco Bay Railroad Company?

A Well, I could not say whether I was or not; it is so long ago that I do not recollect. That company was not long in existence before it was consolidated I believe.

Q 29 Were you a director and officer of the Western Pacific Railroad Company before its consolidation with the San Francisco Bay Rail road Company?

A Well, I do not remember whether I was or not. I think very likely I was, but I could not say so positively.

Q 30 Were you a director and officer of the corporation know as the Western Pacific Railroad Company? Which was formed by the consolidation of the San Francisco Bay Railroad Company and the Western Pacific Railroad Com=pany?

A I could not answer that. I do not remember.

Q 31 Were you a director and officer of the Central Pacific Railroad Company the company formed by the consolidation

between the Central Pacific Railroad Company of California and the Western Pacific Railroad Company?

A If that consolidation was after October 1869. I was.

Q 32 How long were you a director of that Company?

A Of the Central Pacific?

Q 33 Of the Central Pacific Railroad Company that was formed by the consolidation of the Central Pacific Railroad Company of California and the Western Pacific Railroad Company.

A Well, I was an officer of the Central Pacific Railroad Company, through its different consolidations, if there were any at that time up to 1871; in the Spring of 1871 I resigned from all these positions.

Q 34 Then if we assume that the Central Pacific Railroad Co. consolidated with the Cal. and Oregon Railroad Co., the San Joaquin Valley R. R.,Co. and the San Francisco, Oakland and Alameda R. R. Co. on August the 20th 1870, you were a director of the consolidated Company. under the name of the Central Pacific R. R. Co. from the time of such consolidation, up to what month?

A 1871?

Q 35 Up to sometime in 1871?

A Yes sir; in April I think, April on May.

Q 36 When after April or May 1871, did you again become a director of the defendant, the Central Pacific Railroad Company?

A In 1873.

Q 37 Have you been continuously a director of that corporation from 1873 to the present time?

A Yes sir.

Q 38 Were you a director and officer of the corporation known as the California and Oregon Railroad Company?

A Before its consolidation?

Q 39 Yes sir.

A I can not recollect now whether I was or not. I presume I was though I dont know though for certain.

Q 40 Were you a director and officer of the company known as the San Joaquin Valley Railroad Company?

A I think I was.

Q 41 Were you a director and officer of the corporation mentioned in your answer in this case, known as the Contract and Finance Company

A I was — that is, a few months after its organization I was President of it.

Q 42 How long did you remain President of it?

A I remained President of it, until — I think that I remained President of it until the Spring of 1871, but possibly I may he mistaken about it, but I think so, I think I was.

Q 43 After the Spring of 1871, were you at any time an officer or director in that corporation?

A No sir.

Q 44. Did you take any part in the proceed=ings after that time?

A I do not know that it exists; I under stand that it has been dissolved.

Q 46 What is your source of information on that subject?

A Hear-say.

Q 47 You have heard that it has been dissolved?

A Yes sir.

Q 48 Did you take any part in the pro=ceedings for its dissolution?

A I am not positive. I do not think I did. I do not think that I was an officer of it. I was a stock-holder in it. I may have taken action as a stockholder; I presume I did.

Q 49 Are you an officer of the corporation know as the Western Development Company?

A No sir.

Q 50 Have you ever been?

A No sir.

Q 51 Have you taken any part in the direction of the affairs of that corporation?

A How do you mean; what do you mean by direction of the affairs? If I was not an officer, what direction could I take?

Q 52 Who is the President of the corporation?

A I do not know.

A I think that Mr — Judge I am very poor in memory of names Can you put that name in my mouth?

Mr. Sanderson 254[underlined] Douty.

A. Douty — I think he is the President or Secretary I do not remember which

Mr. Cohen[underlined] 255 do you know when that company was incorporated?

A I do not remember now.

Q 56 Was it while you were a director of the Central Pacific Railroad Company?

A Well let me see I think it was.

Q 57 Did you take any part in its incor=poration or organization?

A I do not remember of taking any now.

Q 58 Did you have any interest in the corpor=ation?

A Yes.

Q 59 In what respect?

A I was a stock-holder.

Q 60 Who were the other stockholders of the corporation if you know, besides your self?

A I do not remember.

Q 61 Was Leland Stanford, a stock-holder in that corporation?

A I do not know.

A I cannot answer.
