Q 28 It is alleged in the complaints in these actions,
that these contracts were made an or about
the 20th day of April 1870.?

A. Probably according to my recollecting there
were about as far back as that, but I can't
identify the year.

Q 29 Was it sometime during the year 1870, and
after the date that these contracts were alleged to
have been made?

A. I am only able to say that Mr. Aspinwall
had told me that he sold his stock to Mr. Huntington.
But I am not able to fix the year nor from any
circumstance that I can recall.

Q 30 You have stated that Mr. Huntington
had no authority to make these contracts as
far as you were concerned. Have you any
knowledge as to whether he had any authority
from Mr. Charles Crocker., or Mr. Mark Hopkins
to make those contracts on their behalf as well
as yours?

I object to the question as irrelevant and incompetent
so far as any authority derived from Mr. Crocker is concerned,
the evidence of Mr. Crocker is the best evidence on the subject.
