this respect: didn't you know when
you made the settlements, that the

A. At the time they agreed upon the
settlement. I understood that the
Brannan stock was to be included;
Afterwards when I found it was not,
I concluded to settle with those parties,
expecting to make a settlement with
Mr. Brannan without his commencing
a suit.

Q. 15. Did[crossed out] But you knew you were buying simply
the stock held by Mr. Lombard[Lambard] and
associates, and not the stock
of Mr. Brennan[Brannan], when you paid the
sum that you did?

A. When I paid the sum the money to
Mr. Felton, or agreed to pay it, I knew
then of course that the Brannan
matter was not included.

Q. 16. You have spoken of the views of C. P. Huntington on the subject; that
he advised that it was for your
interest to make the settlement, in view of the
securities which you were attempting
to negotiate. Isn't it the fact
