tions hereto annexed, and examined on the part of the de=
fendants, doth depose and say as follows:

Q. 1. State your name, age, place of residence
and occupation.

A. My name is Charles Crocker, my
age if fifty seven years; nearly fifty
eight; my residence is the northwest
corner of California and Taylor Streets
in San Francisco: and my occupa-
tion is railroading, and I am
President of the Southern Pacific
Railroad.

Q. 2. Do you know the character of the
cases in which your testimony is
to be taken?

A. Yes sir.

Q. 3. State what you understand to be
the nature of these cases?

A. I understand that the parties suing
are trying to get an advance on
the price of the stock they sold
to C. P. Huntington.

Q. 4. In other words it is an action
upon contracts for the sale of stocks
