The Witness [after further examination]: The
report which I could not find, which
is posted in the ledger as being of the
date of February 1st, 1868, I find to be a
report dated January 20, 1868, and entered
on the book under date of February 1st.
I now produce that, and make the same
statement in regard to it that I made
in regard to the last one.

Q. 570 Mr. Cohen: That is, you decline to ex=
hibit the contents of it without the advice
of counsel?

A. Yes sir.

Q. 571 The papers which you have in your
possession, which are reports of Leland
Stanford
, made at the dates they bear,
namely; January 20, 1868 and July 29 [9 written over 0], 1868,
respectively, are reports made to the
board of directors of the Central Pacific
Railroad Company of California, are they not?

A. They are so headed, and were made
on the date upon which they purport to
have been made; but they are really, in
fact, not reports made to the board of di=
=rectors or they were never submitted to the
board in their sessions, but they are Gov=
=ernor Stanford's statements of his accounts
given to me and written up by me, and he
