Q The next is D12 for assessments not paid in. Do you know anything about that?

A Those assessments, my recollection is now that he gave me no information with regard to them. Only so far as the assessment book shows.

Q You cannot give any explanation about that?

A No Sir. It runs in my mind that he received money for assessments, but any further than the assessment book shows the entries there I cannot say.

Q Now the items running from D13 to 22 inclusive, which are shown in Exhibit D as freight bills in coal, these are expense bills that are charged to the R M C & I Co. Why did you charge them in that way?

A My recollection is now that Gen Colton brought the bills in to me and told me to charge them up to the Coal Co.

Q Did you know at the time that the bulk of that coal had been used by Colton for his private purposes?

A No Sir I did not. I knew of his receiving coal, carloads of Coal.

Q Did you know that Stanford, Crocker and others received coal for their own use, the same as the other directors, in which they paid the freight?

A With regard to the freight I do not know.

Q The freight you would not know about?

A No sir. I know of their receiving coal.

Q They all received coal?

A Yes Sir, I recollect one car that was for Gov Stanford that was sent out to Warm Springs. I recollect about that.

Q But the freight would be collected by the R R Co?

A Yes Sir.

Q That you would not know about?

A No Sir.

Q And these hills being charged to Expense account instead of to Colton. You are satisfied was done by his order?

A Oh. I know so. Sir. My recollection is now that he brought them in to the office and merely showed them to me and told me to charge them up to the Coal Co. I did not ask him any ques=

Q D. 23. The first is under date November 24. 1871. Coin in Telegraph order to the Superintendent $300. --What can you say about that? It is under the head of money charged the mine and not sent.

A Well I have a recollection of Deuel sending a telegraph order for $300 in coin, but whether it was sent or not, I cannot say.

Q The next in D 24 June 3, 1873 $500 currency, charged as sent to the mine. Can you give any explanation about that? The charge is that this was sent to the mine, there is no voucher for it, and the mine books contain no credit for it.

Q Your entry is --- there is a memorandum in your writing which is filed as a voucher, and reads "purchase of $500 currency to pay some necessary expenses current at the mine by order of the President $430". There is no receipt in the Express Co.

A Well, that was money of course that I did not send. It was money that he ordered obtained and I must have given it to him.

Q Do you know any reason why that should have been charged to the Company?

A No Sir I do not, only it was done by order. I do not know what it was for. Any further than can
