Recall of Commissioners.

Sec. 40. Any Commissioner may at any time be removed by the qualified individual electors
of the Town. The procedure to effect such removal from office shall be as follows:
A petition, signed by twenty-five per cent of the individual registered voters of the Town, demanding
an election of a successor of said incumbent shall be addressed to the Commission and filed with
the Secretary. The petition shall be accompanied by an affidavit signed by one or more of the petitioners
stating the name of the Commissioner sought to be removed, and the ground for such removal, which
affidavit shall be filed with the Secretary. The Commission shall provide blank forms for such petitions,
which shall be kept by and obtained from the Secretary. The Secretary, upon issuing such forms to any person,
shall enter the name of the person to whom issued, the date of such issuance and the number of
such forms issued, in a record to be kept in his office for that purpose, and shall certify on each of
said forms, under his seal, the name of the person to whom issued and the date of the issuance.
No petition shall be field unless it shall bear such certificate of the Secretary. All petitions shall be
returned and filed with the Secretary within thirty days from the issuance of such blank forms. The
petition shall contain a specific statement of the grounds where which the removal is sought. The
signatures to the petition need not all be appended to one paper, but each signer shall add to his signature
his place of residence, giving the street and number. One of the signers of each such paper shall make
oath before an officer competent to administer oaths that the statements contained therein are true, and
that each signature appended to the paper is the genuine signature of the person whose name it purports
to be. All papers composing said petition shall be assembled and filed as one instrument, with endorsement
thereon of the names and addresses of three persons designated as filing said petition.

Sec. 41. Within ten days from the filing of said petition the Secretary shall ascertain by
examination thereof and of the registration books whether the petition is signed by the requisite number of
individual registered voters, and shall attach thereto his certificate showing the result of such examination.
