Mayor and City Council of the City of Fort Worth,

Gentlemen:-

Referring to the accompaning ordinance amending Title 9 Chaper 1 of the Revised Criminal Ordinances by adding thereto Art's. 311a and 311b I have a to say:-

Art. 311a as contained in the accompanying proposed ordinance appears to be within the power of the City Council and a reasonable and valid ordinance.

Art 311b. It seems to me will be held in court to be in excess of the power of the City Council as not tending to promote public peace or order or within any of the general powers given by the City Charter to the Council.

An Ordinance

Amending Title IX, Chapter One of the Revised Criminal Ordinances of the City of Fort Worth, by adding thereto Article 311-a and 311-b.

Be it ordained by the City Council of the City of Fort Worth, that Title IX, Chapter One of the Revise Criminal Ordinances of the City of Fort Worth shall be amended by adding thereto Article 311-a and 311-b as follows:

Article 311-a -- Any person not being an employee or passenger on any street railway car, who shall jump on or off, cling to or hang on to the same while in motion, shall on conviction thereof be fined not less than One or more than Twenty-five Dollars.

Articile 311-b. Any person not being an employee of any Street Railway Company who shall get on any street railway car, and who shall refuse to pay his fare, when demanded, or who shall refuse to deposit his fare in the cash box when passengers are required to so deposit their fares, by the rules of said Company, shall be deemed guilty of a misdeanor, and shall on conviction thereof, be fined not less than One or more than Twenty-five Dollars.

Sec 2- This ordinance shall take effect and be in force now and after to passage and publication assigned by law.
