WHEREAS JAMES M'CORD MADE APPLICATION TO THE CITY COUNCIL OF THE CITY OF FORT WORTH FOR PERMISSION TO PAVE CERTAIN PORTIONS OF MAIN, FRONT AND SEVENTEENTH STREETS IN THE CITY OF FORT WORTH UPON CERTAIN CONDITIONS IN SAID APPLICATION NAMED, AND WHEREAS SAID PROPOSITION WAS ACCEPTED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH ON FEBRUARY 16TH 1900, AND WHEREAS IT WOULD BE MORE SATISFACTORY TO THE CITY OF FORT WORTH TO HAVE SAID PAVING DONE BY THE CITY INSTEAD OF BY PRIVATE CONTRACT.

THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH THAT IF THE SAID JAMES M'CORD SHALL MAKE A SPECIAL DEPOSIT WITH THE TREASURER OF THE CITY OF FORT WORTH OF THE AMOUNT NECESSARY TO DO SAID PAVING THAT THE SAME WILL BE ACCEPTED BY SAID CITY AS A COMPLIANCE IN ALL RESPECTS WITH HIS SAID PROPOSITION AND A PERFORMANCE OF HIS PART OF SAID CONTRACT, ENTITLING HIM TO ALL THE RIGHTS AND PRIVILEGES PROVIDED FOR IN SAID ORIGINAL PROPOSITION.

BE IT FURTHER RESOLVED THAT SAID DEPOSIT SHALL BE MADE UPON ESTIMATES OF THE CITY ENGINEER OF THE CITY OF FORT WORTH OF THE AMOUNT NECESSARY TO DO SAID WORK, AND SO MUCH OF THE FUND SO ARISING FROM SUCH DEPOSIT AS IS NECESSARY TO DO SAID WORK SHALL BE EXPENDED FOR THE SAME, ANY SURPLUS TO BE RETURNED TO THE SAID JAMES M'CORD OR ANY DEFICIENCY IN SAID AMOUNT TO BE SUPPLIED BY HIM. AND THE CITY ENGINEER SHALL REPORT TO THE COUNCIL THE COST OF SAID WORK UPON THE COMPLETION THEREOF AND THE SAID JAMES M'CORD SHALL THEREUPON BE ENTITLED TO A CERTIFICATE FROM THE CITY TREASURER SECRETARY SHOWING THE AMOUNT HE PAID FOR SAID WORK, SO THAT HE MAY BE REIMBURSED TO THAT EXTENT ON STREET PAVING TAXES &C AS HERETOFORE PROVIDED. AND SUCH CERTIFICATE SHALL THEREAFTER BE CONSIDERED AS SUFFICIENT PROOF OF SUCH PAYMENT TO ENTITLE HIM TO SUCH REIMBURSEMENT.

Resolved that the Mayor & City engineer Secy is hereby authorized and empowered and directed to make contracts for street paving such paving to [?] on any and all of the streets in Fort Worth, when the owners of property abutting on said streets shall deposit with the city treasurer sufficient money to pay the Contract price of such paving. And said fund so deposited shall be a special fund for the special purpose of having in front of the property crossed out word owned and designated by those the making persons making the deposit and a receipt shall be issued to the depositions in conformity to a resolution heretofor passed by the City Council to reimburse exempting said property from street paving tax when paving is done by the owner.

Dear Sir:--

I understand a resolution was introduced but not passed at the last council meeting which provided that individuals desiring to pave the streets in front of their property could deposit the estimated amount of cost of same with the City and the City would then let the contract for such work and assume full charges and supervision of same. I am anxious to have the paving around our building on Seventeenth, Front and Main Streets done as soon as possible, and if the city will take charge of the work and rush same to completion, according to the same specifications as used in paving on Hayne triangle, I am ready to deposit the amount necessary to pay our portion of paving said streets around our building with such parties as the City and the contractors, Brown and Dabney, may agree on, provided, of course, that the price to be paid for our part of said work shall be satisfactory to me. If such an arrangement can be made with the city to do this work it would seem important that immediate action be taken so that we can get started on paving the streets of our City.
