Sec.4. That the right, privilege and franchise herein contemplated
is granted upon the following conditions to wit: - 1st - That the
said Knight and Peckham, Associates, their successors and assigns, shall
construct and finish said Railway Line and have the same in good running
order within six months from the passage of this ordinance and operate
same continually thereafter, running cars each way over said Street
Railway Line on a schedule time of at least one car each way every thirty
minutes through each day from six A.M. to 10 P.M., unless prevented
from doing so by some unavoidable accident. -2nd- That said Knight and
Peckham, Associates, their successors and assigns shall keep in good
repair the Streets and Crossing along their said Railway track, that is
to say, between the rails and eighteen inches on each side and that
said track shall be constructed and laid so as not to obstruct travel
on said street. 3rd.- That said Knight and Peckham, Associates, their
successors and assigns shall construct said Street between the rails
and for eighteen inches on each side thereof with the same material
as the rest of the street and in such a manner as the City Engineer may
demand and shall have the track of said Railway in good repair as may be
from time to time demanded by the City Engineer.

Sec. 5. That the Knight and Peckham, Associates, their successors
and assigns, shall lay and keep the top of their rails on a level with
said Street and shall at all times be subject to the public ordinances
and regulations now existing or which may hereafter be adopted by the
City Council of the said City.

Sec 6. That said City of Fort Worth shall not be respondisble for
damage of any kind that may arise from the negligent construction
or operation of said Street Railway and that Knight and Peckham,
Associates, their successors and assigns agree and bind themselves by
proceeding to construct said Street Railway under this ordinance to
pay to the City of Fort Worth as liquidated damages any sum or sums of
money that shall be legally assessed, adjudged or decreed against
said City by virtue or any negligence or misconduct in the contruct-
ion or operation of the said Street Railway.

Sec. 7. That said Street Railway shall be constructed under the
supervision of the City Engineer of said City of Frt. Worth and the
said Knight and Peckham, Associated, their successors and assigns
