Provenance:

Donated to the Greene County Clerk of Courts Office, Courthouse, Waynesburg, Pennsylvania. No record of donor maintained. It appears that the docket book was passed down from one JP to the next, thus covering a large span of years and including entries from more than one person. I. C. Booher frequently identifies himself in the context of the marriages he performed, as well as in regard to in some of his criminal file entries. Likewise, G. W. Smith is identified as the JP to perform a list of the later marriage entries.

Due to the fact that Pennsylvania did not officially record marriages until 1885 at the Courthouse, the records in this docket are an invaluable record for family history.

In addition to marriages, this JP docket includes criminal matters. Please review these with the understanding that genealogical research requires an open mind. Ancestors were human too. Each should be remembered and treated respectfully, but also with an unbiased examination of the facts. These records have the potential to provide useful clues and details regarding family alignments, everyday life, biographical profiles, and more.

Record specifications:

Justice of the Peace dockets are not typically maintained by the Clerk of Courts Office. This book is in the custody of the office due to donation by the JP or his heirs. As a result, the Clerk of Courts may not issue certified copies of any of these records. In an effort to make the rare material in these dockets available, they are being scanned and transcribed on volunteer time for sharing via the Greene Connections: Greene County, Pennsylvania Archives Project.

In order to maximize volunteer time, the first 44 pages of this docket were not scanned at this time due to the largely financial nature of the entries. As time and resources permit, the docket will be revisited to add those entries to the digital archive.

Since the pages in this docket were scanned individually, the images are numbered according to their handwritten page numbers, if they have one. However, there are some errors in the hand-written page numbering system.

**Page 53 skips next to page 56. Pages 54 and 55 are not missing, they are simply not included in the handwritten numbers.

**Pages 86, 87, and 89 are numbered twice. These have been kept in original order by making image "A" and "AA" pages that are incorporated into the number sequence following the correct facing pages.

Commonwealth vs Martin Barney

July 24th 1887 warrant issued S. H. Barnett debty & on oath of Jesse L Barney charged the defendant with having on Sunday the 24th inst made an assault upon him and George Barney, and violently kicking at them and taking down the gun in his hands and threatened their lives.

Same day deft brought up and after hearing the interchange of words by the parties, adjourned to 25th inst. Parties appeared. Adjourned by consent of the parties to Saturday the 30th inst 9 o'clock am. Parties having chosen Jesse Lazear, Daniel Goodwin, and Nathaniel Lyons to assist in a compromise, to meet as above stated. Parties notified July 30th 1887. Parties met and affected a compromise by which all proceedings in this case be discontinued each party agreeing to pay one half of the costs accrued in this case. See agreement in hands of N. Lyons bearing [Given?] date herewith. Signed by [M] Barney, G. [N or W]. Barney and J L Barney. Dismissed accordingly Oct 4th [recd] of M Barney three dollars and sixty cents. His cost as per araignment of the above parties. Recd of Jesse L Barney three and 60/100 dollars balance of costs in full in this case docket recd satisfaction.

Claim for damages to sheep Acts of May 25 1893. Information of M M Knox taken Oct 22nd 1894. Same day auditors notified, and [report] received awarding claimant $10 for [7] killed & damage to flock $25, total $35. with costs one dollar each to S Grim & S Drake and one dollars justice fees costs paid by claimant. total $3.00 auditors receipts for their costs on their report, and now Oct 27th/94 Justice certifies to the foregoing report and hands same to the complainant docket satisfied accordingly.

Greene County. SS on this 18th day of Mar 1892 Personally appeared Henry Jacobs of Richhill township Greene County Pa before the undersigned and makes complaint that on Monday night last past he had some of his sheep killed wounded and others damaged by some dog or dogs.

Whereupon upon notice was issued and served upon Samuel Grim & S H Barnett two of the auditors of said township and whereas the said auditors after making dilligent inquery in relation to said claim submit the following report March 22 1892 find two killed valued $8.00 and damage to flock 13.00 less two pelts got by owner 1.00 auditor S H Barnett fees 2.70 [auditor] Sam Grim [fees] 2.50 Henry Jacobs witness .98 serving notice on auditors .66 Witness James McDonald .56 justice Booher (see act) charged to Jacobs .50 less the above one dollar $28.90 and now March 23, 1892 certificate [issued] to the complainant I. C. Booher J.P.

Greene County SS Personally appeared before the undersigned one of the Justices of the Peace in and for the said county Henry Jacobs who being duly sworn deposes and says that on Monday the 26 day of December 1892 three dogs belonging to David Courtwright in the township of Richhill in the said county did wound & damage three of his sheep & otherwise damage the flock. whereupon notice was issued and served personally on auditor S H Barnett by the complainant in persuance of said notice two of the auditors of said township did examine the [premises] on Dec 31st/92 find from the evidence that three (3) dogs belonging to David Courtwright was caught on the flock of sheep of 54 head belonging to said Jacobs with two badly wounded and others injured. with damage as follows. Damage eight dollars with costs of action as follows now Jan 4th 1893 certificate issued to the Honorable School Board of Richhill township Greene County Pa for the plff.

Greene County:SS: On this 14th day of June AD 1892

Personally appeared before the undersigned Parker P Miller of Richhill Township in the said county being duly sworn says that from his best information he believes that two dogs owned and kept by John Burnfield in the said township did on or about June 8th 1892 did wound and kill four of his sheep and further damage his flock [& e]

Whereupon notice was issued and served by Charles Patterson on S.H. Barnett personally Barnett agreeing to notify S Grim being two of the auditors of said township. And now June 17th 1892 Received the following report, (Namely) we the undersigned auditors of Richhill Tp Greene Co PA having been summoned according to law to appear on the premises of P. Miller for the purpose of appraising the damage to flock of sheep caused by dog or dogs of John Burnfield. Proven by Jane Carroll. Find the loss and damage to be twenty two dollars with costs $22.00 auditors fee 5.20 Mrs Jane Carroll witness fees .56 Signed Samuel Grim & S.H. Barnett, au. Charles Patterson serving notice (pd 50) 50 Justice fees (paid 1.00) 1.00 certificate issued to the complainant &e $29.82 June 30th 1892, I C Booher J.P. Justice paid Charly Patterson above fifty cents in the road near his home.

Aug 17th 93 complainant paid costs to Justice $1.50 costs marked paid.

Commonwealth vs Harvey Burns Justice Ent[er] complaint .25 paid by complainent

Sept 16th AD 1893 personally appeared Lizzie Breal of Richhill Twp Greene Co PA who makes oath against Harvey Burns of the same place Co & state afore said charged the said Burns that on the 30th day of may last past on the 8th day of June last past with having commited adultery upon her at her home on the said township Sept 28th 1893 parties having mutually agreed to try and settle all matters at variance. and it is further agreed to meet at my office Oct 3rd 1893 at 2 o'clock PM.
