A commonplace book kept by Parsons outling various legal issues including getting a negro with child, slander, deceit, bills of exchange, debt,assault and battery, quantum meruit by a physician, ejectment, covenant, and liberty of the yard. Many of these topics include also forms of declaration.

Biographical Notes

Parsons practiced law in Massachusetts from 1774. He was active in discussions of the new constitution proposed in Massachusetts in 1778. He served as chief justice of the Massachusetts Supreme Judicial Court (1806-1813).

Debt for not Exhibiting an Inventory

and that no inventory of the said estate or of any part thereof hath to their day hath been exhibited into the said office nor hath any land been given for the payment of the debt and legacies of said [?] whereby the said Jonathan hath forfeited the sum of £5 a month for his neglecting thereof for each and every month from and after the ____ day of ____ until the ____ day of ____ last being ____ months amounting in the whole to the sum of ____ one moiety thereof to and for the use of the poor or the said town of ____ and the other moitey thereof to the Ptt wherefore and by virtue of the law aforesaid an action hath [?] to the Ptt to demand have and recover the last mentioned form of the said Jonathan for the user aforesaid yet the said [?]. Tho [?] hath not paid the same but unjustly detain it.

Debt for not Making a Passage for Fish

Summoner David Bearlow of ____ to another to William Adams of ____ who sues their action as well for the poor of the said Town of ____ as for [?] in a plea of debt for that the said David on the ____ day of ____ was and ever since hath been the owner [?] of a certain Milldam long before that time erected and made [?] of a certain stream in ____ aforesaid called and known by the name of ____ being a stream where the salmon shad alewives and other fish usually passed into the natural pond above to cast their spawn, but the said David hath never made a sufficient pasageway for the fish to pass up the said stream either thro' or round the said dam from the ____ day of ____ to the ____ day of ____ instant by season whereof the said fish during all the time and season were wholly prevented from passing up the stream aforesaid contrary to an act or law of our Prov. of Massachusseth Bay made in the fifteenth year of the reigh of our late royal grandfather intitled "an act in supplement to an act made to prevent the destruction of fish called alewives and other fish" whereby an action hath accrued to the said William who sues as foresaid.

aforesaid to demand and have of the said David the sum in fifty pounds one hay thereof for the use of the Ptt the other half thereof for the use of the [poor] of the town of ____ aforesaid yet the said David tho' requested hath not said it but unjustly detain it to the damage of the said [?] who sues as aforesaid the sum of.

Debt on the Funeral Act

Attach A. of ____ to [answer?] to B. of ____ who sues this action as well for the poor of the town of ____. As for himself in a plea of debt for that whereas C. late of ____ aforesaid gent having made his will and appointed the said A executor thereof died and afterwards on the ____ day of ____ was buried and the said A being executor as aforesaid and having the regulation of the funeral of the said C. did on the said ____ day of ____ at ____ aforesaid give more gloves than his pair to the said C.'s bearers and one pair to each minister of the church or congregation to which the said C. belonged [ag.] [?] of this province in that case made and provided whereby the said hath forfeited fifty pounds lawful money one moriety thereof to the said B. who sues for the same got the said A. has not paid the same tho' requested but unjustly detain it.

Debt on the Militia Act

Summon A.B. of ____ to answer C.D. of ____ clerk of the military foot company in ____ aforesaid who sues this action as well for said company as for himself in a plea of debt for that E.F. captain of the said company on the ____ day of ____ and on the ____ day of ____ at said ____ drew up and mustered the said company to improve them in military arts and exercises in the usual place for that purpose; and the said A.B. then belonged to said company and was liable to train it yet he without cause neglected to attend on each of those matters altho he was duly warned to attend them whereby he by force of the Province laws in that behalf provided hath forfeited [5?] for each of those neglected being
