To The Marshall of our Court of Vice Admiralty Greeting We Command you that of the Goods Chattels and Effects lately in our Said Court condemmed as lawfull prize to the [Uss?] of John [Maudsley?] Commander of the King George privateer his owners officers and Mariners in the hand of his agents you cause to be made three hundred Spanish Dollars [Costs?] or the value thereof in Silver or Gold which Thomas Canalas Master of the Sloop Elizabeth & Anna a Spanish Flag of Truce recovered in our Said Court as the allowance permitted him to [Cary?] to defray his wants and necessity. And that money you have before our Judge and Commissary of the Said Court with all convenient Speed to Render unto the Said Thomas Canales his [recovery?] [af.^d?] herein fail not and make due Return thereof togather with this writ Witness Joseph Anderson Esq.^r Judge of our Said Court the 15^th day of December 1747

Having fully considered the Libel answer and proofs thereon, and heard the allegations and pleadings of both parties, I am of Opinion that the tobacco mentioned in the Libel ought to be forfeited and confiscated, being taken on board & waterborn without any permit pocket sufferance or other clearance first obtained from the proper ^ (Officer) or Officers of the Customs of this port and without paying (^or securing to be paid) His Majesties duty thereon: I do therefore Adjudge & Decree the same to be forfeited and confiscated and order the same to be sold at publick Vendue ^ (by the Marshal of this Court) at Edenton the twenty ninth day of this Instant November to the highest Bidder, and that the money arising thereby be distributed to wit One third to His Majesty, One third to His Excelly the Governor and One third to John Hult Collector and Prosecutor. And I do further Order, adjudge & Decree that the [peltianger?] with her Apparrel and furniture and also the other goods mentioned in the (word crossed out) ^ (inventory) and referred to by the (three words crossed out) ^ (Libel) be acquitted and discharged; and that the same be restored to the owner or Claimant after paying the Costs to be [levied?] by this Court, and ^ (the) other incident charges of this suit.

I hereby empower and appoint Mr Samuel Sinclair a[ct]ing Proctor to appear in a Court of admiralty now held at B[o]th T[..]n on the tryall of a certain vessel taken & sent in to Course sound, by Captain John Mawdsley under the care & charge of Latham Clark appointed price master, by the said Mawdsley from whom [Recd] a power of attorney, at the instance & request of Messrs John Brown Senr. & John Brown Junr agents appointed by the Company belonging to the King George Privateer, belonging to the Government of Rhood Island, and for so doing this shall be your sufficient power given under my hand ye 27th day of [..]br 1747 Geo.
