Sir

The Colonial Secretary having placed before his Excellency the Governor in Council your letter o fthe 1st instant covering a report from Acting Sub Inspector Aubin upon a collision which recently occurred between the detachment of Native Police under his command and a party of Natives camped near the "Mornish Diggings" in the vicinity of Rockhampton, I am directed to inform you that after a careful consideration of the whole of the facts set out in Mr Aubin's report the Executive Council fail to perceive that that officer has justified himself in adopting the extreme measures he did upon the occasion above referred to, and under the circumstances His Excellency with the advice of the Executive Council has directed Mr Aubin's immediate dismissal from the Public Service which decision I have to request you will covey to that officer.
