Sworn Information (General Purposes)

Queensland

Clermont

To Wit.

Be it remembered that on this First day of April, in the year of our Lord one thousand eight hundred and seventy six, in the District of Clermont, in the Colony of Queensland, George Dyas of Clermont, appears personally before me the undersigned one of Her Majestys [sic] Justices, duly assigned to keep the Peace of our Lady the Queen, in and for the District of Clermont, and Territory of Queensland, and he informs me that on the 15th day of March, in the year of our Lord one thousand eight hundred and seventy six, one Frederick Wheeler, did at Mistake Creek in the Colony aforesaid, feloniously, wilfully, and of his Malice aforethought, kill and murder one Jemmy an Aboriginal, contrary to the Act in such case made and provided; whereupon the said George Dyas prays that I the said Justice will proceed in the premises according to Law.

The examination of Paul Love of Clermont, in the Colony of Queensland, Senior Constable of Police, George Dyas of Clermont Sub Inspector of Police, John Hugh Harricks of Clermont Surgeon, Robert McGavin of Dittley Stockman, Thomas Baker, of the Belyando Constable, and Frank Hamilton, of Dittley in the said Colony Laborer, taken on oath this Tenth day of April, in the year of our Lord one thousand eight hundred and seventy six, at Clermont in the Colony aforesaid, before the undersigned one of Her Majestys [sic] Justices of the Peace for the said Colony, in the presence and hearing of Frederick Wheeler who is charged this day before me for that he the said Frederick Wheeler, on the fifteenth day of March 1876, at Mistake Creek in the said Colony did feloniously, wilfully, and of his malice aforethought, kill and murder one Jemmy an Aboriginal.

3rd April 1876

Frederick Wheeler before the Court, charged for that he the said Frederick Wheeler, on the 15th day of March 1876 in the Colony of Queensland, did feloniously and wilfully and of his malice aforethought, kill and murder one Jemmy an Aboriginal.

This Deponent Paul Love on oath states. I am Senior Constable of Police stationed at Clermont. I know the prisoner now before the Court. I arrested him yesterday about half past eleven o'clock, at the Belyando Native Police Barracks under the warrant produced. I read the warrant to him, I said "I have a warrant for your arrest Mr Wheeler." I then produced the warrant and read it to him. The prisoner replied "That is all right." He made no further remark I escorted him into
