ORDINANCES OF THE CITY OF GREENVILLE. 111

SEC. 2. That no person or persons shall wantonly disturb the spring or the branches therein, by throwing into them, or any of them, sticks, stones or trash, or by washing the person or any article therein of any kind or description.

SEC. 3. That it shall be unlawful for any disreputable or loose character to walk within the City Park at any time to the annoyance of peaceable citizens.

SEC. 4. That it shall be unlawful for any person to engage in noisy disputes or conversations in said Park, or in any other manner behave disorderly therein or in the vicinity so as to disturb the peace quiet or good order of the place.

SEC. 6. That any person or persons offending against any of the provisions of this Ordinance shall be subject to a penalty of not exceeding twenty-five dollars for each and every offence, at the discretion of the Mayor.

Ratified the forth day of August, one thousand eight hundred and eighty-five. --------------------

PRISONERS.

AN ORDINANCE Providing for the Better Securement of prisoners at Work upon the Public Streets of the said City.

SEC. 1. That whenever, in the opinion of the Mayor or acting Mayor, it is necessary in order to secure and safely keep in custody any erson or persons sentenced to work upon the public streets of the city, the said Mayor or acting Mayor is hereby authorized to require said person or persons to be secured by use of ball and chain, or in such other manner as the said Mayor or acting Mayor may deem advisable and expedient.

SEC. 2. Any person or persons who shall resist or obstruct an officer of said city in carrying out the provision

AN ORDINANCE Providing for the Working of the Prisoners of the City of Greenville upone the Streets of said City-

SEC. 1. That from tand after the passage of this Ordinance it shall be lawful, and the Mayor or acting Mayor of the city of Greenville, is hereby authorized and empowered in his discretion, to sentence all prisoners convicted by him, to work upon the streets, public ways or places of the city of Greenville in the city chain gang for the number of days the said prisoner or prisoners are sentenced to be confined.

SEC. 2. All ordinances or parts of ordinances inconsistent with this Ordinance be, and the same are hereby repealed.

Ratifed 6th day of October, 1896. ---------------------------

RAILROADS.

AN ORDINANCE to Provide for a Subscription to the Atlanta and Richmond Air Line Railway company, and to Alter and Amend an Ordinance on the Same Subject, Dated the Twentieth of May, A.D. 1870.

SEC. 1. That the Mayor be authorized to subscribe the sum of Fifty Thousand Dollars to the capital stock of the Atlanta & Richmond Air Line Railway Company, in South Carolina, or any company with which it may consolidate, upon conditions following: (1st.) That siad subscription shall be paid in coupon bonds of the city of Greenville, bearing interest at the rate of seven per centum per annum, payable at not less than sixty-six and two-third cents of their par value, so that the issue of the bonds

authorized under this Ordinance shall not exceed the sum of seventy-five thousand dollars ($75,000): and provided, (2nd.) That the said railroad be located through the incorporate limits of the city of Greenville.

SEC. 2. The subscription authorized by this Ordinance shall be paid as follows, viz: An installment of one-eighth (1/8) of the said subscription shall be delivered to the Air Line Railway Company. upon satisfactory evidence being furnished to the City Council that the work of grading has been commenced between Spartanburg and the city of Greenville, and an additional installment of oneeighth every three months thereafter, as the work of grading progresses : Provided, That at least three miles of grading upon said road be completed between Spartanburg C. H. and Greenville C. H. for each installment paid paid and before the same is paid : And provided further, That the Mayor be authorized and required to withhold any installments of the city subscription if, from any cause, the work of grading be discontinued.

SEC. 3. The bonds authrized by this Ordinance shall be exempt from all taxation of either principal or interest by the city, and shall be payable as follows : On 1st January, 1880. $7,500; on 1st January, 1883, $7,500; on

That the bonds shall be of the donomination as follows, viz : Two hundred and fifty bonds of one hundred dollars each, and one hundred bonds of five hundred dollars, all to be signed by the Mayor and Clerk and Treasurer oi the city, and sealed with the seal of the Council. structed to issue immediately of the bonds of the city, prepared for that purpose, bonds to the amount of sixtysix thousand, five hundred dollars computed at seventyfive cents on the dollar, in exchange for fifty thousand dollars of the capital stock of the Atlanta and Richmond Air Line Railway Company.

SEC. 2. That one half in amount of the bonds provided in Section first of this Ordinance to be issued, shall bear interest at the rate of seven per centum per annum, from the first day of July next, and that the remaining onehalf of said bonds shall bear interest at the same rate from the first day of January, A. D. 1872.

SEC. 3. That the balance on the subscription aforesaid, amounting to one hundred and twenty-five dollars, which shall remain uppaid when the bonds aforesaid shall have been issued and delivered, as hereinbefore provided for, shall be paid in cash from any funds which may be in the hands of the City Treasurer.

AN ORDINANCE in Reference to the Air Line Railway Company.

SEC. 1. That the Atlanta and Richmond Air Line Railway Company be authorized to cross, with their track, the following streets in the city, to wit: Pendleton street, opposite the Greenville and Columbia depot; Rhett street, in rear of lot belonging to Wm. C. Harris and -- street, and between the lots belonging to Thomas Q. Donaldson and Mrs. Jane Berry : Provided, That the said City Council may prescribe all necessary regulations for the protection of persons and vehicles passing along said streets.

116 ORDINANCES OF THE CITY OF GREENVIELLE.

AN ORDINANCE to Regulate Railroad Crossings.

SEC. 1. That the respective railroad companies whose tracks cross the streets of the city of Greenville be required to plank at such respective crossings for the breadth of the streets, between and on the side of their rails, so as to make the same convenient of passage, and also to keep such planking in repair.

SEC. 2. It shall be the duty of railroad companies, after five days' notice form the Mayor, to station at the crossing of any designated lane, street or alley across which the track may run, a man with a red flag, whose duty it shall be to show the flag whenever a train may be approaching or corssing such lane, street or alley.

SEC. 3. It shall be the duty of the flagman to prevent the crossing of the railroad at which he may be stationed by vehicles or pedestrians when a locomotive or train may be crossing or approaching such street, lane or alley; and any person attempting to cross any railroad after being warned by the flagman, shall be liable to a fine not exceeding ten dollars.

SEC. 4. That it shall be unlawful for any railway corporation to stop any engine or cars on any street or alley in the city of Greenville.

SEC. 5. That the said railroad companies be notified of the provisions of this Ordinance, and on non-compliance within ten days after such notificaiton, or for a violation of a ny of the foregoing provisions, shall for each offence forfeit a sum of not exceeding fifty dollars.

SEC. 6. It is hereby made the duty of the police to en force the provisions of this Ordinance.

of a System of Sewerage for the city of Greenville, South Carolina, and Providing for the Issuing of Sew erage Bonds in an Amount not Exceeding Seventy-Five Thousand Dollars for the Same.

SEC. 1. That the Mayor of said city is hereby authorized to issue coupon bonds of the city of Greenvillein the sum of seventy-five thoughsand dolalrs for establishing, constructing and maintaining a system of sewerage for the city of Greenville as provided for by the Act of the General Assembly, ratified on the 22nd day of December, 1891, said system to be constructed as Council may authorize and direct.

SEC. 2. That the bonds authorized by this Ordinance shall be exempt from all taxation by said city, and shall be payable thirty years from the date of said issue.

SEC. 4. That said bonds shall be of the denominations as follows: Five hundred dollars, and signed by the Mayor and Clerk and Treasurer of the city, and sealed with the seal of the Council. The interest on the same to be six per centum per annum and shall be paid semiannually on the first day of January and the first day of July in New York, or the city of Greenville, at the option of the holders of the bonds, and the coupons shall be receivable at par for taxes and all other dues to the city of Greenville, and shall be so expressed on this face.

SEC. 4. That said bonds shall be of the denomination of five hundred dollars each; shall bear date the first day of February, 1892, and shall bear interst from the first day of January, 1892; that they shall be signed by the Mayor and Clerk of said city, and sealed with the corporate seal; that the interest thereon shall be six per centum per annum, payable semi-annually on each first day of July and first day of January ensuing the date thereof. in the city of New York or the city of Greenville, at the option of the holder, upon presentation of the coupons therefor attached to said bonds.

SEC. 5. For the purpose of paying the interest on said

bonds semi-annually, as heretofore provided for, and the principal when due, Council shall levy and collect the necessary amounts upon the real and personal property in said city.

SEC. 6. That the form of bond prepared. Lithographed by Messrs. Arthur & Bonnell, of New York city, and submitted to Council. be and the same is hereby approved and adopted, and so soon as siad bonds are signed and sealed, as hereinbefore directed, the said Mayor and the Finance Committee of said Council are authorized and empowered to negotiate and sell the same for not less than par and accrued interest, and the date of said bonds shall be regarded as the date of issue.

SEWERAGE.

AN ORDINANCE Fixing and Regulating the use of Sewers by Private Parties in the City of Greenville, S. C.

SEC. 1. The sanitary system of sewers in this city consists of man and lateral conduits of salt glazed, vitrified sewer pipe and necessary accessories. They are designed to carry off all liquid house wastes, and are known as sanitary sewers, The sewers leading from the main or lateral sewers to the property on either side are called house sewers. Porus drains, laid for removing surface water, are called sub-soil drains.

CONNECTIONS.

SEC. 2. All connections fo house sewers, drains or plumbing work with the sewer system of this city shall be made in accordance with the following rules and regulations:

SEC. 3. No person, firm or corporation shall lay, alter or repair any house drain, sewer or plumbing work, or make any connections whatever with any drain or sewer belonging to the sanitary system, or to do any

work connected wit hthe laying of house drains house sewers, or plumbing or making any repairs. additions or alterations of any drain, sewer or blumbing connected, or to be connected , with the sanitary sewer system, unless regularly licensed by the City Council

APPLICATION FOR THE LICENSE.

SEC. 4. Any person desiring to do business as a blumber in connection with the dewer system shall file in the office of the City Clerk in petition, giving the name of the individual, or firm, and place of business, and asking to be licensed as a plumber. Said petition must be signed by two responsible citizens of the city of Greenville, vouching for the business capacity and reputation of the applicant; that he is a resident of the city, a master of his trade, and willing to be governed in all respects by the rules and regulations which are, or may be adopted by Council for the protection of said sewers. Each applicant for license shall execute and deposite in the office of The City Clerk with his applicaiton a bond, with two or more resident sureties, to be approved by the Finance Committee, in the sum of five hundred dollars, condiioned that he will replace or srestore sidewalk, paving or street surfacing over any opening he may have made. to as good state and condition as he found it, and keep and maitain the same in good order for over a period of six months, to the satisfaction of the proper street officer, and that he will pay all fines imposed on him for a violation of any of these rules or regulations. No license shall be granted for more than one year, and all licenses shall be granted to expire on the first day of January. Removal of residence from city shall act as a forfeiture of license.

PERMITS.

SEC. 5. Applicants for permits to connect with sewer system, or do plumbing work to be connected therewith, must be made in writing by the owner of the property or his authorized agent. Such applications shall give the exact location of the property, the name of the owner,

and the name of the persons employed to do the work, and shall be made on blanks to be furnished for that purpose. No permit shall be deemed to authorize anything not stated in the application, and for any misrepresentation in such application the plumber shall be suspended, and if the misrepresentation appears to be wilful his license shall be revoked.

Permits to connect with the sewer system will be issued only when the plumbing to be connected is in accordance with the rules for plumbing hereinafter prescribed, and has been inspected by the Superintendent of sewers, or in case of new buildings when a proper plan for the plumbing has been approved by the Superintendent. The Superintendent will designate the position of Y Branch in the streets as shown by the records of his office. (taken at time of construction) all connections made with sanitary sewers or drains, and all plumbing connections therewith shall be made under the direction of the Superintendent of sewers.

For issuing such permit a fee of two dollars shall be charged, which shall include cost of inspection of connection, but each job may be inspected as often as may be neccessary to insure a strict compliance with good sanitary requirements; and for each and every such inspection the city shall be paid the sum of one dollar by the plumber, contractor or owner : Provided, however, The inspection fee shall not exceed 2 1/2 per cent, upon the contract price, unless the contract price should be less than $200, in which case the inspection fee shall not exceed 2 1/2 per cent, on $200 (or $5); and to insure the collection of such fees each licensed plumber shall deposit with the City Clerk and Treasurer the sum of $25, which shall be placed to his credit on a book kept for that purpose, and shall be charged each week with the inspection fees as reported by the inspector of plumbing, and if such plumber should at any time allow his deposit with the Treasurer to become exhausted, then the Treasurer shall notify the City Engineer in writing, and he shall not

issue to such plumber any more permits until he or they have deposited with the Treasurer sufficient funds to cover any such delinquent fees, together with the deposit as required by the foregoing Section.

PLAN OF PLUMBING.

SEC. 6. Before a permit will be issued for doing plumbing work in a building, or before any additions are made, excepting necessary repairs, a plan and description of the work to be done, signed by a licensed plumber on blanks furnished for the purpose, shall be filed by the Superintendent of sewers, and no such work shall be commenced until such plan shall be approved by the Superintendent. Every plan shall contain a clear and full description of the plumbing, showing the position, size, kind and weight of all pipes and the position and kind of traps, closets and other fixtures, and the work done under these plans shall be subject to the inspection of the Superintendent of sewers, and no alterations shall be made in any plan or in the work without a special permit in writing from him.

INSPECTION.

SEC. 7. The Superintendent is to be given notice when any work is ready for inspection, and all work is to be left uncovered and convenient for examination until inspected and approved, such inspections to be made within twenty-four hours after such notification. The Superintendent may apply the either, peppermint, water or smoke test; and the plumber shall supply the necessary tools, material and assistants for such test. The plumber shall remove any defective material of labor when ordered by by the Superintendent.

STATEMENT OF WORK DONE.

SEC. 8. The plumber shall at the completion of the work file in the office of the Superintendent of sewers, on blanks furnished for the purpose, a correct statement of the work done under the permit
