Mc Curdy JM Comer and RW Cobb agree to pay the State of Alabama Fifteen Hundred Dollars, unless the said WA McCurdy appear at the next Term of the Circuit Court of Shelby County and from Term to Term thereafter until discharged by law, to answer a criminal prosecution for the offense of Manslaughter in the 1st degree and we hereby waive the benefit of all law exempting property from levy and sale, under execution or other process for the collection of debt, by the Constitution and laws of the State of Alabama. The State of Alabama } Circuit Court Shelby County } Spring Term 1880

The Grand Jury of said County charge that before the finding of this Indictment, Wallace Comer and W.A. Mc Curdy, the christian name of said McCurdy being unknown to the Grand jury, unlawfully and intentionally but without malice, killed a "convict" negro man whose christian and sir name are to the Grand Jury unknown by beating whipping or cruel treatment, th seaid negro man being convict sentenced to hard labor & under the charge case or superintendence of said Wallace Comer, & W.A. Mc Curdy.

The grand Jury of said County further charge that before the finding of this Indictment, Wallace Comer & W.A. McCurdy. the christian name of said McCurdy being unknown to the Grand Jury, did unlawfully & intentionally, but without malice, kill one negro man, who name is to the Grand Jury unknown. Said negro man being a convict sentenced to hard labor for the county State & under the charge, care, or superintendence of said Comer & Mc Curdy, by pursuing and chasing him said negro man with dogs, & permitting or making said dogs bite & lacerate him, said negro and by whipping and beating him the said negro
