Seattle Wash Sept 20th 1895 To the Hon the Mayor and City Council of the City of Seattle. Gentlemen your petitioners would respectfully represent to your honorable body that we are the lawful owners of Lots Nos 7&8 in Block No 40 Maynard's Plat of the City of Seattle. Said lots being situated on the west side of South 8th Street between King and Weller Streets in said city. that we and each of use have erected large and Costly houses and improvements on said lots and each of them which are now upon the same. That your honorable body has heretofore passed an ordinance providing for the grading of said South 8th Street in Front of said lots owned by your petitioners. Your

petitioners further represent that under and by virtue of said ordinance a contract has been awarded for the purpose of grading said Street and work is now being prosecuted under the same. That the contractor to whom said construction was let is proceeding to grade said street inaccordance with the grade on the same heretofore established by the City of Seattle. That if he prosecuted said work in accordance with said grade the Street in front of said lots owned by your petitioners will be about six feet highter than it now is thus placing the lots of your petitioners and the improvments thereon about twenty four (24) feet

below the grade of said street that the grading of siad street as aforsaid will greatly damage and injure said property or your petitioiners That each of your petitioners will suffer therefrom damage in the sum of Two thousand dollars or a total damage of Four thousand dollars. That said work is being prosecuted without any just compensation or otherwise hearing been made to petitioners for said damages which we and each of us will sustain by reason of the grading of said street. We therefore enter this our protest against the unlawful taking and damaging of our said property for a public use without just compensatin therefore before said work is prosecuted in front of our property
