183 COMMON COUNCIL OF THE CITY OF SEATTLE Dec 8/82 be and are hereby granted until next meeting in which to report on the petition of A.S. Pinkham. Applications for Licenses From Aug. Le Ballister & Co. for retail liquors. Granted. Ordered that the Legislative and Judiciary Committee be and they are hereby instructed to submit at next meeting an Ordinance in reference to assessment levy and their collection of taxes. Ordered that the City Surveyor be and he is hereby instructed to submit at next meeting plans and specifications for a cistern at the corner of Marion and 3rd Streets said estimates to show the cost of wood and brick cisterns. Ordered that the City Surveyor be and he is hereby instructed to submit at next meeting plans, specifications and estimates for the planking of Commercial, South 2d, Jackson, Main, Washington, Mill and Front Streets. Ordered that the Council stand now adjourned until Friday December 15 1882. By reason of the absence from the City of His Honor the Mayor H. G. Struve Councilman John Collins is elected to the position of Acting Mayor to serve during such absence. 184 JOURNAL OF THE PROCEEDINGS OF THE Dec 10/82 and a small part of Water Street. Granted upon condition that said petitioner shall vacate said Streets after 60 days notice to that effect. Communications and Reports Received From His Honor the Mayor H. G. Struve returning an Ordinance entitled "An Ordinance for extending the time for the completion of the contracts for grading Front, Union, Second and Third Streets" without his approval and with his objections in writing to such approval which objections read as follows, to wit: "Office of the Mayor of the City of Seattle December 1882 to the Hon. Common Council of the City of Seattle Gentlemen. I return without any approval the Ordinance passed by your Hon. body on December 8th 1882 granting to the constructors for grading Front, Union, Second and Third Streets an extension of time for the completion of their contract. I do not think that the interests of the City are sufficiently guarded by its provisions. Section three of the Ordinance provides that it shall not take effect until said contractors shall have filed with the City Clerk a relinquishment in waiting of six weeks interest upon all scrip issued to them upon said contracts. This Section is liable to two objections. In the first place the scrip issued to the contractors may be in the hands of third parties on which event the contractors would not be in position to make the relinquisment. In the second place, this ordinance modifies to some extent the original contract for said improvements the performance of which is secured by the bond of the contractors and their sureties. Hence there ought to be a provision in this ordinance requiring the Contractors and their sureties to file a written acceptance of the provisions of the Ordinance and an agreement that the contract may be modified in the manner provided. I recommend that instead of a relinquishment of the interest by the contractor as provided, the amount of such interest so computed be deducted from the final payment of the contractors. 185 COMMON COUNCIL OF THE CITY OF SEATTLE Dec 15/82 to the City Attorney From Health Officer submitting a report for 4 months ending December 1 1882. Approved From City Surveyor submitting estimates of the cost of the proposed planking of portions of Commercial, Jackson, Main, Mill, South 2d and Front Streets. Approved. Ordered that the City Attorney submit proper ordinances for the grading and planking of the following streets or portions thereof, to wit: Planking Commercial from the south side of Mill to the north line of King Planking Jackson from the alley west of Commercial to Commercial Planking Main from the alley west of Commercial to Commercial Planking Mill from present planking east to east side of Front Grading South 2d from north side of Main to the Wharf Planking South 2d from north side of Main to Wharf Grading Main from Commercial to 2d Planking Main from Commercial to 2d Grading Jackson from Commercial to 2d Planking Jackson from Commercial to 2d Grading Front from Mill to Madison Planking Front from Mill to Madison The vote on said order is as follows, to wit: In favor of said order Collins, Cosper, Clancy, Gasch, McDonald and Manning. Against said order none. From City Surveyor submitting comparative estimates of a wood and brick cutter corner of 3rd and Marion Streets. Referred to the Committee on Fire and Water Supply. Adopted and warrant ordered issued in favor of said Leary for $50.00 in full for all said damages. Committee in Streets and Street Improvements granted one week's further time to report on the petition of Roswell Scott. Ordered that the Gas Committee submit at next meeting patterns for a new style of lamp post. Ordered that the Committee on Gas Lights be and they are hereby instructed to erect a gas lamp at the southwest corner of the New City Engine House. Ordered that the petition of M.S.Booth et al for a gas lamp corner 4th and Jefferson Streets be and is hereby denied. From Licenses and Revenue granting the application of Eskson & Locke for a Bowling Alley. Granted and license ordered issued. Applications for Licenses From Frank Peters for retail liquors & Maria Goldberg for grocery. Referred to the Comtee. on Licenses and Revenue. Claims paid The following claims having been duly audited by the Council are ordered paid by warrants drawn on the funds and in the amounts following, to wit: City Fund E. L. The following Officers are present, His Honor Acting Mayor Councilman John Collins and Councilmen O. F. Cosper, Fred Gasch,Chas F. McDonald and G. L. Manning. Thereupon the following proceedings are had Petitions Received From Pumphrey and Lowman et al for a standing place for teams. Referred to the City Attorney. Committees Reports Received From Fire and Water Supply approving the estimate of the Surveyor for a brick cistern corner 3rd and Marion Streets. Laid over. From Fire and Water Supply recommending an additional section to the proposed amendment to Ordinance No. 278 reserving the right to the City to purchase certain water works. Adopted and referred to the City Attorney to make such amendment and fixing the date of such purchase after 10 years. From Gas Lights submitting a plan for a gas lamp post. Referred to Gas Comtee. for a new contract and bond to be executed by Washington Iron Works for such post as former rates of compensation.
