This indenture made the Between Robert Hughe of the state of North Carolina and County of Cumberland of the one part and John Taylor]of the same State & County of the other part Wilneſseth that for and in consideration of the sum of One hundred & fifty pounds Current money of this State to the said Robert Hughe in hand paid by the said John Taylor at or before the signing or sealing or delivering of these presents, the Receipt whereof for the said Robert Hughe doth hereby acknowledge and therefore doth Release, aequis and discharge John Taylor his Executors and administratiors By these presents He the said Robert Hughe hath granted bargained sold, alined and confirmed and by these [presents] doth grant bargain, sell alien and confirm

THIS INDENTURE, made this , between Benjamin Smith Esquire of the one part, and the Trustees of the University of North Carolina of the other part,

WITNESSETH: That for and in consideration of the singular good will he hath to the said UNIVERSITY, and the desire he hath to render the most essential service to his Country by promoting useful knowledge and good morals, and for the further consideration of five shillings, the receipt whereof is hereby acknowledged, the said Benjamin Smith hath given, granted, aliened and confirmed, and by these presents doth give and grant, alien and confirm unto the said TRUSTEES of the UNIVERSITY of NORTH CAROLINA, and their successors, certain tracts or parcels of land, situate lying and being in the Western part of the State of North Carolina, on Forke or Deer River, and bounded as follows, viz.,

One tract on the South side of said River, BEGINNING at two poplars and a dogwood marked HR, six miles South of the first bluff on said river from its mouth, said Smith's corner runs with his line South one hundred and sixty chain to a poplar; thence West one hundred and eightyseven and a half chains to a stake; thence North one hundred and sixty chains to a stake on said Smith's line, then along his line East to the beginning, containing Three Thousand acres, more or less.

One other tract, BEGINNING on the South side of said River at a hickory and dogwood marked HR, Griffin Rutherford and said Smith's corner, four miles South of the first bluff from said river; thence South along said Smith's line one hundred and sixty chains to two poplars and a dogwood marked HR, said Smith's corner; thence along his line West

Containing five thousand acres.

And one other tract, lying on the North fork of said river, BEGINNING at a large white oak, sweet gum, and ash marked R I C, John Carter's N. E. corner, and on Benjamin McCullocks line runs with his line East two hundred and forty chains to a hickory and two elms, his corner and Edward Sharp's line; thence along his line South one hundred and twenty-five chains to a scaley barked hickory and elm , said Sharp's and Benjamin Smith's corner; thence along his line and William Hawkins's West two hundred and forty chains to a stake, said Carter's corner; thence along his line North to the Beginning. Containing three thousand acres.

And also one other tract lying on said river, BEGINNING at a gum and leaning sycamore marked HR on the river bank, at the mouth of a small branch, and at the foot of the first bluff from the mouth of said river, Martin Armstrong and Griffith Rutherford's corner, runs with said Rutherford's South one hundred and sixty chains to two hickorys and a dogwood saplin marked HR his and said Smith's corner; thence with his line West three hundred and twelve and a half chains to a stake, his corner; thence North one hundred and sixty chains to a stake; thence East three hundred and twelve and a half chains to the beginning. Containing five thousand acres, and all houses, buildings, orchards, ways, waters, water courses, profits, commodities, hereditaments, and appurtenances, whatsoever to the said premises, hereby granted and any part ,thereof belonging, and in anywise appurtaining, and the reversion and reversions, remainder and remainders, rents, issues and profits thereof, and all the estate, right, title, interest, use, trust, property, claim and demand whatsoever of him, the said Benjamin Smith of in and to the said premises, and all deeds, evidences and writings touching or in anywise concerning the same.
