the defense made no defense whatever, but merely submitted their case on the testimony of the prosecution -- US Dist Atty Charley Jones opened for the prosecution, arguing an hour & 25 minutes, till noon recess -- PM, Woodburn for the defense argued 2 hours, closing at 3:35 -- when court adjourned -- I reported to the Journal as usual --

Saturday May 2

Variable cold -- Genl Clarke for prosecution argued 3 1/4 hours -- Judge Hawley's charge occupied 50 minutes, and at 3:45 case was submitted to the jury, which then returned for deliberation, and the court took a recess -- at 4:20 the jury came in with verdict of "guilty as charged in the indictment" -- They took only 2 ballots -- first, 11 to 1, and second unanimous for conviction -- Was taken to the County Jail by the Marshal and from there to the State Prison at 10 -- Evening at Opera House -- Ezra Kendall in "A Pair of Kids" -- He very good & funny -- rest not much -- play ditto --

Variable -- PM snowing in the mountains -- letter to wife & one to Webster -- Trimmed toenails & to bed at 1 --

Monday May 4

Variable -- The only business in court this morning was the sentence of Johnny Jones to eight years in the State Prison and a fine of $5,000 -- Accompanied by the US Marshall he visited his home, wife and children, bade them good bye & about noon was taken to the Prison in a carriage with Warden Henderson and the Secretary of the prison -- Johnny took it apparently, in good spirits, bade all the boys a festive "Good bye, and come and see me," but looked a little thoughtful as he turned & left for the enforced quietude and retirement of his prison home -- I met Webster in street & he paid me $10 -- still owes me $10 for last week -- Town trustees election today -- Republicans and Silverites -- Repubs won -- highest majority 112 out of 424 cast --

Tuesday May 5

Strong, variable & cold with occasional snowsqualls -- No court -- no news -- Chas H Fish my old time Comstock friend, now Prest of the Con Va mine passed up to the Comstock this morning -- I met him at the train -- Bill Sutherland, printer, Va came down here this morning and started in on the "Jag" cure at the Keeley Institute -- Wrote & mailed letter to P J Keyes Va this evening -- Bed 1 --

Wednesday May 6

Same -- Comstock payroll for April, $60,376.64 -- $1,000 more than last month -- Bed at 1 -- cleared off fine -- US detectives Gallaher and Barker who have been here all through the Jones trial left this evening for the East --

Mason & Detectives Leave for the East -- 39 Journal Letter Revoked -- Moved Into Room 13 1896 -- Wife and Bessie -- Charley Gilland Charley Fish Returns to SF

Thursday May 7

Cloudy & warmer -- Andrew Mason left for the East this evening -- I saw him off -- US detectives Gallaher and Barker left last evening, also for the East, so I guess mint matters are to take a rest for the present, at last, -- Evening I sent letter to Journal but afterward didn't like it so I went to telegraph office & sent following message to Journal -- "Dont publish my letter on mint matters sent this evening." I moved into room No 13 this PM, from my room 7 just exactly opposite of hallway -- Evening about town -- Bed at 1:30 in my new quarters, that unlucky number 13 -- Received letter from wife and Bessie today -- sent one to Webster --

Friday May 8

Very blustering, dusty disagreeable day -- Sent letter to wife -- met Charley Gilland of Reno, an old new acquaintance this evening, & we had a late supper of shell oysters, etc. He is in from Buckeye where he is interested

Variable & cold, with a few light snow or hail squalls -- Republican State convention held at Va today to elect 6 delegates and 6 alternates to the National Convention at St Louis June 16 -- Delegates chose, AC Cleveland, Enoch Strother, JB Overton, CH Sproule, WD Phillips, GF Furritin -- Sent "Capitol Notes" to Journal At train met Judge WH Virden & wife, on their way to S.F. from their home in Bridgeport, Mono Co Cal -- Bed 12:30 -- Sharp, frosty night --

Sunday May 10

Variable, cold and blustering -- Sent letter to J A Miller, Austin -- "Porcupine Bill," WS Beard, went up to the Rep State Convention from Reno yesterday & returned here this evening -- goes back to Reno tomorrow night -- so he says Webster sent me $10 today --

Dramatic Co, about 20 including an excellent brass band & orchestra were at Opera House tonight -- I attended -- Admission 10, 20 & 30 cents -- Jam crowded house -- comedy of "Farmer Stebbins" -- Very good & amusing, with song varieties -- Played at Va all last week to crowded houses, the biggest last Friday night, over 1,000 present -- Biggest Piper has had for years -- Bed 2 --

Tuesday May 12

Clear & very pleasant -- Band drill of the Shaw Co at noon on the street yesterday and today very fine and attracted crowds of people -- They are here for the week -- Evening they played "La Belle Marie" to crowded house -- Excellent -- Fine orchestra -- Out at 11:30 -- Bed 1 --

Wednesday May 13

Same -- Second day of real spring weather -- Dined with John H Dennis and S H Day ("Harry" Day) at Day's residence -- Had beans, Spanish style -- Evening at theater -- "Fogg's Ferry" another tremendous well pleased audience -- Very good light comedy play -- amusing -- the boss orchestra -- The daily band drill at noon is a very popular feature --

Thursday May 14

Same -- letter from wife, inclosing one from Bessie to Sam, and a telegram
