In the Matter of the Estate
of
Brigham Young, deceased.

Order Authorizing Execution
of Correction Deed.
No. 553

W. W. Caldwell and Vera M. Caldwell having heretofore filed in
this court their verified petition praying for an order authorizing and
directing Brigham S. Young, the successor trustee under the last will
and testament of said Brigham Young, deceased, to execute a correction
deed to the real property hereinafter particularly described, and said
matter coming on regularly for hearing this 19th day of January, 1944,
and it appearing to the court, as the court now finds, that due and legal
notice of the hearing of said petition was given by the said petitioners
and by the Clerk of said Court in pursuance of and as provided in the order
of this court specifying the notice to be given;

And it further appearing, as the court further finds, that George
Q. Cannon
, Brigham Young and Albert Carrington were, by the terms and
provisions of the last will of said Brigham Young, deceased, named as
executors and trustees thereof and of said estate and that they duly qualified
and entered upon the discharge of their duties as such, but that all
of them have since died and that the said Brigham S. Young was thereafter
appointed by this court as successor trustee to the trustees above named
and qualified as such and is still the duly appointed, qualified and acting
trustee under said will;

And it further appearing, as the court further finds, that the
said Brigham Young in his lifetime was the owner of the real property
hereinafter particularly described, and that the same and other property
was sold and conveyed by his said executors to one Jens Hanson, a predecessor
in interest of said petitioners, but that through an error and inadvertence
the same was incorrectly described in said conveyance; that the said
petitioners through mesne conveyances have become the owners thereof, as joint tenants and
that the failure to correctly describe said real property cast a cloud
