Spring City (Utah) Council Minutes

Geo. Brough dates April 30, 79, asking that a portion of the water be transferred from the old field to land not entitled to water; petition not granted, as the council did not wisht to act in direct opposition to the voice of the people who in main meeting assembly on May 8, 1879 voted that water be not trans ferred outside of the old fields. The recorder was instructed to inform Mr. Brough of the action of the council. A similar petition from S.G. Bunnel was read and despozed of same as above. The petition of B.M. Hudson regarding bridg ing the places where water crosses the side walks was read and T B. Allred was appoin ted to inform Mr. Hudson that the council would consider the mater & fix certain places. Prayer by Mayor Larson. Council adjourned for [own]meeting Tuesday, June 10, 1879. CIty Council met in the tithing office Prayer by the Mayor. The committee appointed to visit Jonas Brough reported that he will not [prompt]any of the land in Sec. 33. Five Doll. ($5.) was appropriated to Jonas Brough to reimburse him for expenses incurred in filing on N.W. 1/4 of Sec. 33 part of which is clamed for municipal purposes.

The Mayor stated that the treasurer desired a fixed percentage as compensation for collecting and paying out the city wheat. It was moved, seconded, & carried that the treasurer be allowed to deduct ten (10) lbs wheat per lb. for shrinkage, waste, and trouble. Prayer by H. Olson. Council adjourned for two weeks Tuesday, June 24, 1879. Council met in the tithing office. Councilor H. Olson presiding. Prayer by H. Olson. A petition was read from John F. Allred asking the privilage of piling building material on the St. west of his lot for a period of six (6) months which was granted. The decision of the High Council of the Sanpete Stake of Zion granting to Spring City the first right to the water of Canal and Oak creeks was read. Jos. T. Ellis G. W. Allred, and John T. Lambert were appointed a board of water supervisors under the direction of the city council Prayer G H. Olson.

Decision of the Presidency and High Council of the Sanpete Stake of Zion on the rights to the use of the water of Canal, Oak and Cedar Creeks - in the following named cases. Chester vrs. Olsen & Larsen for Spring City; George W. Brough vrs. Olsen and Larson for Spring City; Nicoli Lund against Olsen and Larsen for Spring City; and C. W. Moore & J. P. Allred against Olsen &Larsen for Spring City. That the rights of land owners in the various fields herin after mentioned in, and to the waters of Canal, Oak and Ceder Creeks be and the same are hereby declared in the following manner. Spring City old surveys, including Olsens point and Chimney Surveys amounting to 2 642 acres have the first right of water from Canaland Oak creeks. waste waters to be turned into the old channel of Canal creek. Fred. Olsen's survey north of the Sprint City old survey shall shall continue to hold an undisputed right to one half the waters of Cedar creek. Spring City little field survey and 152 acres also the Beck & Candland survey at Chester to the amt. of 40 acres, and the L.T.S Allred field on the Flat S.E.

of Spring City to the amt. of 20 acres shall be considered coeved in the second claim. Land under Cultivation in 1877 12 1/2 " " " " 1876 additional 0 Total 12 1/2 1438 1/2 The water master of Spring City is hereby empowered to divide and regulate the water of Spring City creeks as herein before provided. and in case his acts in regard to any matter pertaining to the division or regulation of the said water, should be dissatisfactory to the watermasters of the aforesaid surveys or to either of them they, or any of them may refer the matter in dispute to the following named, George Taylor of Ephraim, James Crawford of Manti and Niels Christiansen of Ephraim who are hereby appointed and constituted [umpires] for that purpose and their decision shall be final. The expenses of the said umpires shall be paid by the land owner of the several surveys pro rate to their perspective water interests.

Saturday, June 27, 1879 City Council met in the tithing office. Councilors F. Olsen presiding. Prayer by Lauritz Larsen. Councilor F. Olson stated that the council were called to hear the report of the Head Water Master and the board of water supervisors as regards the water in the several ditches and condition of the grain in the fields, and to see if it is possible to spare any water to the various claims outside of the fields. Jos. A. Allred Head Water Master made a statement regarding the grain and ditches in the field. Stated that some parts of the field required more water and that others could spare some. Jos. T. Ellis, Green W. Allred, and Ramus Justeson acting in the absence of John T. Sambert board of water supervisors gave a verbal report that all all of the water in the fields was required to mature the crops and that much was suffering through the scarcity of water. Councilor S Larson mentiond that in view of the report of the board supervisors

we are not justified in taking out any water from the field to be given to to the fields outside, which was recorded and carried. The head water master was instructed to turn a little more water to the little field and take it from the Point. Also that the water running to the lower chimney be turned to the uper chimney. The board of water supervisors were asked to present their report in writing. Council adjourned till July 3, 1879. Prayer by John T Lambert.

Report of the board of water Supervisors "To the [Hon.] the Mayor and City Council: Gentlemen: - We the board of water supervisors respectfully present to you our report in [regard] to the amount of water the condition of the crops and distribution of the water. We found some of grain in the Little Field suffering also the same in the South field. The crops in the Point field looked well not suffering. The upper land in the Chimney field was late and very dry needing more water. The grain in the lower Chimney field was looking well and in good condition

Grain in Fork of the creek in good condition. North field some suffering and some looking well. We found the water equally divided in the ditches. To take any water out of the field would destroy the crops while with the greatest economy of the water much of the grain will be shrunk. We went to the Dam and ditches of Chester and found as much water running as there was at the bridge by Neilson's for the South field and the Point field. Yours respectfully, Joseph T. Ellis, G. Thursday, July 3, 1879 The council met in the Tithing Office, Mayor Larson presiding. Prayer by John T. Lambert. The Mayor stated that the council would hear the statement of the committee apointed by the people to superintend the working of springs in the mountains.

After hearing Messers Behumin and G.W. Allred the council agreed to send six men and two teams two weeks upon the mountains under the direction of Marten Behumin to continue the work and increase the water T.B. Allred and John Schofield were ap pointed a committee to hire five men at the most favorable rater. It was also agreed that Green W. Allred would go in the canyon for three days with those who were willing to work their portion of the expensis. A petition from Peter M. Molter was read asking the privilege of allowing building material to lay on the sidewalk adjoining his lot which was granted for a reasonable time - Council adjourned [Same Dis.] Prayer by T. B. Allred. Wednesday July 9, 1879. Council met in the Tithing office. Mayor Larsen presiding. - Prayer by Louritz Larsen. Louis Olsen applied for a licience to [leb] butches meet which was granted on paiment of Two Dollars & fifty cents. ($2.50/100) A petition from R.W. Allred Jun. asking the privilege of laying building material on the street opposite his lot for a reasonable time. Petition granted Instructions regarding water were given

to the Head Watermaster. w Councilor T.B. Allred who had been up in the mountains; stated that the men had come down; as he thought the amount of water gained would not pay the cost. Several of the members of the council expressed themselves on the subject. Prayer by Jos. K Allred. Council adjourned tile July 15, 1879. Tuesday, July 15, 1879. Council met in the tiching office. Allred The bill for compensation to those who worked in the mountains under the direction of Morton Behunin was read and Sixty Eight (68) lb. wheat was agreed to be paid out of the city Treasury to be collected from the people according to the pro rata land owned by each A resolution extending the time for the assessor to make his returns from the 15th of July to the 15th of August was passed.
