P.N. Broker an acting justice of
the peace in and for said county
[illegible word] Scarborough whose name by her mark is subscribed
to the annexed and foregoing deed to Jefferson J Watts and
acknowleged that she signed sealed and delivered the same
for the true meaning and interest thereof with any fear
or threats or compulsion or otherwise of her said husband
as withnessth my hand seal this 9th day of Nov

Defendant then introduced and read to the jury a deed only
recorded from said Watts to him Defendant conveying all
of said land to him which is there was no proof that defen
dant had any notice or knowledege of a fraud in the making
of the deed from Scarborough to Watts nor any actual notice of
the purchase by plaintif at Sheriff sale
which is the words and
figures following and was duly recorded xc [ illegible word]
Know all men by these presents that we Jefferson J Watts
and Meary Jane his wife of the County of Perry and state
of Alabama for and in consideration of the sum of twelve hun-
dred Dollars to us in hand paid by Robert Smith of the
County and State aforesaid the [ illegible word] whereof we do hereby
acknowledge have granted bargained sold and conveyed
and by these presents do grant bargain sell and convey
unto the said Robert Smith his heirs and assigns all that
tract or parcel of land situated in the County and
State aforesaid know and distinguised as the east
half of south east fourth and south fourth of south east
fourth of north eas fourth all in section thirty seix township
eighteen and range six east, together with all and singular
the hereditaments and appurtenances therewith belonging to
have and to hold the same with the said Robert Smith his
