did not pay it. said [ illegible word] also testified. that he paid had paid
on account of Watts liabilities to Scarborough about five hundred
and forty dollars on judgements and executions against Scarborough
but did not state the time, when the same was said except it
was after the sale from Scarborough to Watts nor did he name
the executions or judgements on which it was paid. nor did defen-
dant show any execution or judgements that had been paid by
Watts or [ illegible word] for Watts against said Scarborough as shown
by the record. Same were shown and circumstances to show the
same were paid by Watts for Scarboro, plaintiff then in order
to show that the deed from Scarborough to Watts was fraudulent
and mad to defraud his creditors, and was without consideration
First introduced as witness one Izelle. Who was a witness
to the execution of said deed who stated that he subscribed
his name to said deed as witness that Scarborough and Watts
were both present, that he say no money paid by Watts to Scar-
borough. nor did he see any notes given. nor did he know any
consideration paid by said Watts to Scarborough for said lands
plaintiff next introduced the deposition of one Nelly Elliot who
testified that John Scarborough had been in the undisturbed
possession of said lands for about ten years and that no other
person had been in possession all that time. what in 1841 said
Scarborough (who was the "step son") came to here and told
her he had loaned his name to Levi Langdon to draw money
out of the Bank, and that he was afraid he would lose his
his land. that it would be sold to pay that debt and wanted
her to purchase said lands and hold it until she was paid
three hundred dollars which Scarborough owed her as guardian
[illegible word] and that he still wanted to cultivate it if she purchased it
she told him she was a band bad hand to keep secrets, and if any
person were to ask her whether she had purchased the land for
good or only for a while. she would be obliged to tell it was
only for a while ~ Two hundred Dollars of the amount [ illegible word] her
still remains unpaid, that in a few days afterwards Scarborough
