told her he had sold his lands to said Watts on the same terms
he proposed to sell it to her. Plaintiff here proposed to prove
by this Witness that Scarborough while in possession of said Land
and [ illegible word ] before he left it. but after the sale to Watts told her
he had made a sale of his lands a few days before that, to said
Watts, and that he said that the first sale to said Watts was all
a show which evidence the fourt excluded and the plaintiff
excepted, the plaintiffs also proposed to show by other witnesses
the declaration of said Scarborough after the sale of said
lands to said Watts but while in possession of the said lands
tending to show that said deed was without consideration
and mad to defaud creditors which was excluded by the
court and plaintiffs excepted. Plaintiff then introduced
one Samuel Elliot who testified that said Scarborough
a day or two before he sold said land to said Watts en-
[illegible word] to get him to take the titles of said land to prevent
oit from being sold. for a debt of Levi Langdon on which
he had loand said Langdon his name to draw money from
the Bank, Plaintiff also introduced proof tho show that Defts
had reseded within a mile and a half of said lands at the
time of the sale of said lands to Watts and ever since, plaintiff
proposed to read the following testimony which was excluded
by the Court and plaintiffs excepted read to the jury
the following statement of the declaration of Jefferson J
Watts (after the dat of his deed from Scarborough) from
the deposition of Mrs Nelly Elliot. I had a conversation
with said Jefferson J Watts in the early part of the [illegible word]
of spring 1844 in which he stated
This witness further states
that said Watts was the son in law of said [illegible word] and the
Brother in law of said Scarborough. plaintiff then intro-
duced one Streed who testified that in 1842 said Watts
offered to sell him said land as he undrstood as the
land of said Scarborough that he offered him $7.00 per
acre which said Watts said he would take if said
Scarborough was willing. but that Scarborough was not
