IN THE DISTRICT COURT OF THE SECOND JUDICIAL DISTRICT COURTOF THE TERRITORY OF UTAH. Beaver County,

The People of the Territory of Utah Send Greeting to Samuel Willis, Samuel Pollock, St. George formerly of Kanarraville Bishop Henry Sant, Cedar City John Hamilton, Sr. Fort Hamilton

WE COMMAND YOU, That all and singular business and excuses being laid aside, you appear and attend before the Second Judicial District Court of the Territory of Utah, at a term of said Court to be held aat the Court House in Beaver City on the 12th day of April, A.D.1875, at 10 o'clock AM., then and there to testify in the above untitled action now pending in said District Court, on the part of the Defendants and disobedience will be punished as a contempt by the said Court.

WITNESS, Hon. J. S. Boreman Judge of the Second Judicial District Court in and for Utah Territory, this 20th day of March A.D 1875. ATTEST, my hand and the Seal of said Court the day and year lst above written. James R. Wilkins Clerk

Why did you not as Governor institute proceedings forthwith to investigate that massacre, and bring the guilty authors thereof to justice?

13th

Did you about the 10th of September 1857 receive a comunication from Isaac C. Haight or any other person of Cedar City, concerning a company of emigrants called the Arkansas company?

Have you that communication?

Did you answer this communication?

Will you state the substance of your letter to him?

and I did not know how soon he might arrive and because the United States Judges were not in the Territory. Soon after Governor Cumming arrived I asked him to take Judge Cradlebaugh who belonged to the Southern District with him and I would accompany them with sufficient aid to investigate the matter and bring the offenders to Justice.

13th I did receive a communication from Isaac C. Haight or John D. Lee who was then a farmer for the Indians.

14th I have not. I have made diligent search for it but cannot find it.

15th He saith: I did to Isaac C. Haight who was then the acting President at Cedar City.

16th He saith: Yes.-It was to let this Company of emigrants and all companies

gun that they would kill every soul; interpreters tried to regain the stock or a portion of them by presents but in vain the Indians told them to mind their own business or their lives would not be safe?

Since that occurence no Co. has been able to pass without some of our interpreters to talk & explain matters to the Indians.

Friendly feelings yet remain between the Natives & the settlers & I have no hesitancy in saying that it will increase so long as we treat them kindly. I deal honorably towards them I have been b'lest in my labors the present year much grain has been raised for the Indians.

I herewith furnish you the acts of the W. H. Dame of Parowan for cattle wagons &c furnished for the benefit of the chief Owanup (SS) for 2 yoke oxen $100.00 each, one wagon & chains $75 total $275.00 2 Cows $30 each, for labor $80 total $140.00 $415.00

P.A. Smith Cedar City Iron Co. for 2 yoke cattle $100 for Wms & Moqueeteses Bands 200.00 $100 for 1 Cow $35 do to 1 wagon $80 total $115.00 Total $315.00
