Q. 9 State what you know of the purchase by the plaintiff of a certain parcel of land mentioned in the complaint, known as Block 9.

A. I know nothing of it, except the fact that it was purchased.

Q. 10 How do you know it was purchased?

A. By its having been paid for by the Central Pacific Railroad Company, and, I presume, by having seen the deed; but I do not recollect distinctly.

Q. 11 How much did the Central Pacific Railroad Company pay for that property?

A. $250000, I think.

Q. 12 To whom did they pay it?

A. I cannot state positively. I think, however, it was paid through the bank.

Q. 13 Which bank?

A. The Bank of California, I think: — Perhaps deposited there for the account of Mr. Tichenor. It seems to me that is the way the payment was made, but I may be mistaken about that.

Q. 14 Mr. Robinson: You do not make payments, do you?

A. No sir.

A. No; not of my own knowledge. He was paid a salary at a certain time — I don't know whether my answer would be a proper answer — which, at the rate that salary was paid afterwards, must have commenced on the first of April, 1869

Q. 72 By whom was that payment made?

A. By the Central Pacific Railroad Company.

Q. 73 Mr. Robinson: After the consolidation?

A. After the consolidation. It covered ser= =vices for the Western Pacific Railroad Company — so specified — for the Western Pacific and Central Pacific

Q. 74 Mr. Cohen: You say that in com= =menced on the first of April, 1869?

A. It commenced on the first of April, 1869

Q. 75 You state that positively, as a fact within your own knowledge?

A. Within my own knowledge, arriving at the fact in that way.

A. Yes.

Q.168 Was that made, as the attesting clause imports, by the direction of the board of directors of your company?

A. It was.

Mr. Robinson: Not the fact that this bill of sale is made by the Central Pacific Railroad Company, successor by consolidat= =tion under the laws of the state of Cal= =ifornia to the Western Pacific Railroad Company.

Q. 169 Mr. Cohen: I believe that, at the same time you executed this, you executed a similar instrument, transferring the schooner "Truckee," did you not?

Obj'n Mr. Robinson: We object to any testimony regarding the contents of any written in= =strument without its being produced or its absence accounted for.

A. I presume so, but I do not recollect the fact. I know they were both sold.

A. Yes sir; a part of the time. I was not a stockholder and Director of the Contract and Finance Com= pany during the entire period of it existence.

Q. 143. Were there any other suits than those which have been mentioned, brought against the Central Pacific Railroad Company California, or the Central Pacific Railroad, or the directors of either of those Corporations by the stockholders prior to the commencement of this action?

A. I dont[don't] know when this action was commenced.

Q. 144. Was that prior to the year 1878?

A. I dont[don't] know, but you had some= think to do with an action prior to that, as counsel for Mr. Robinson: but I dont[don't] remember what year that was.

Q. 145. In the year 1876, was there not an action commenced by John R. Robinson and others, plaintiffs, against the Central Pacific Railroad Company's['s crossed out] & Directors and others, with respect to some stock which those parties claimed to own?

A. I think they do.

Q. 878 Will those books show all the pay= =ments made by the Contract and Finance Company, by way of dividends to their stock= =holders, of money, bonds, stocks or other property?

A. I think they show the entire trans= =actions of the Company.

Q. 879 Mr. Lake: Answer that directly. [Question repeated.]

A. I don't know that there were any dividends other than money or stock. If there were any the books show it. The books show the entire transactions of the Company.

Mr. Cohen: Note the fact that the books are not in our possession. We are perfectly willing to take the evidence from them if we can get them.
