TO THE COMMON COUNCIL OF THE CITY OF SEATTLE. We, the undersigned being the property owners on Anna Street from Powell to Gayler Streets in the City of Seattle, Washington, respectfully represent and show that the said Anna Street is at the present time being graded and that the rise from Powell Street to Bradley on said Anna Street is 57 feet in the total distance of 250 feet and that said Street as now being graded will show cuts of about 10 to 12 feet. That said Street when so graded will be impassable for any kind of vehicles and will be of no practicable use as a Street for oridinary traffic. And that said Street as now being graded has the sidewalk placed at the lot line with a Park 6 feet wide between the sidewalk and the gutter. It is therefore the wish and desire of your petitioners that said Street from Powell Street to Bradley Street might be graded so that the Park 6 feet wide would be allowed between the line of the lot and the sidewalk instead of as originally petitioned the balance of the Street to remain as originally petitioned. Some of your petitioners further represent that while they signed the original position for the grading of said Anna Street they did the same under a misapprehension thinking the property would be graded in the manner above requested, and did not learn of their mistake until the ordinance for the grading of said Street had passed both Houses of your Honorable Body, and been signed by the Mayor. Some of your petitioners further represent that by reason of the heavy cuts as aforsaid, they have a cause of action and will claim damages against the City for the grading of said Street, as is now proposed, but that in consideration of the granting of this petition they will surrender any and all claim of damages which they may have by the grading of this Street. Your petitioners further request that if it be possible the grade on said Anna Street and between Powell and Bradley Streets be raised as much as possible so as to avoid the deep and heavy cuts now made between said two Streets.
