To the Hon. Mayor and the House of Delegates and the Board of Alderman of the city of Seattle:

Gentlemen:

When South Ninth Street was ordered graded and sidewalked, the improvement was ordered to be made as far south as Charles Street; and assessment district was created including property as far south as Charles Street: In carrying out the improvement the street was not graded that far, and was not graded nor sidewalked in front of my lot; on October 28th, 1889, I paid the assessment on my lot, being Lot Number Eight of Block Number Six of Plummer's Addition, the amount of the tax being $39.12, believeing that the street would be improved as far as the ordinance under which the work was done called for. As the street never has been graded nor sidewalked as far as Charles Street, and not improved at all in front of my property, I respectfully request that the amount of tax paid by me for the assessment, with interest at 10 per cent, be returned to me. I have the original receipt given me at the time the tax was paid, and the treasurer's books show the payment also, while it is a well known fact that South Ninth Street has not been graded as far south as Charles Street, and has not been improved in front of my lot.

Wherefore, I respectfully petition your Honorable Body to refund to me the tax paid, and interest thereon, and your peititioner will ever pray &c.

Seattle, Washington, June 13th, 1892.

To the Board of Aldermen and the House of Delegates of the City of Seattle:

the petition of Hans Ahrenstedt, a citizen of the city of Seattle, respecfully shows unto your Honors:

1. that at all the times mentioned in this petition Hans Ahrenstedt was and is now a resident of and a citizen of the City of Seattle.

2. That at all the times hereinmentioned your petitioner was and is now the owner of the following described property, together with the dwelling house located thereon: Lot number eight of Block six of Plummer's Addition to the City of Seattle.

3. That on the 10th day of May, 1889, the Common Council passed an Ordinance, Numbered 1086, which provided for the grading and sidewalking of South Ninth Street in the City of Seattle from Yesler Avenue South to Charles Street; which said ordinance was on the 13th day of May, 1889, duly approved by the Mayor of Seattle and became a law.

4. That the property belonging to your petitioner is situated between Charles Street and Yesler Avenue, and would front on said South Ninth Street if said street was extended through to said Charles Street.

5. That said South Ninth Street was not graded from Yesler Avenue south entirely to Charles Street, but the grading and sidewalking of said South Ninth Street was stopped about sixty feet from Charles Street, and before reaching the property of your petitioner, and no grading or other improvements of said South Ninth Street was done in front of the property of your petitioner.

8. That an assessment was levied on the property of your petitioner, amounting to $39.12, and your petitioner, believing that said grading and sidewalking would be carried through to said Charles Street, as provided by said Ordinance No. 1086, paid said sum of $39.12 into the City Treasury of the City of Seattle, and re ceived a receipt for the same on the 18th day of October, 1889, which receipt reads as follows:

Seattle, Oct. 28, 1889. Received from Hans Ahrenstedt Thirty Nine 12/100 dollars for Street Improvements on Lots 8 Block 6 Plummers Addition, So Ninth Street.

7. That your petitioner paid sum sun believing that said south Ninth Street would be graded and improved from Yesler Avenue south to Charles Street, as provided by said Ordinance, and believing that the property of your petitioner would be greatly benefitted by said improvement, and would be liable to said assessment; whereas in fact said street has not been graded through to Charles Street, has not been improved in front of the property of your petitioner, and his property has not been benefitted by it:

WHEREFORE, your petitioners prays that said assessment of $39.12 may be refunded to him. And you petitioner will ever pray &c

Ordered that the City Surveyor submit [lans and specification and the Clerk directed to advertise for bids for building wharves on Commercial and South Second Streets. Ordered that the Street Committee be instructed to present a feasible plan for opening West Street south to Union St, also opening the alley west of Front Street from that point south. Plat of Mountain View Addition to the City of Seattle approved On motion the plat of Rutland is rejected. Ordered that the Council donow adjourn Approved Thomas T Minor mayor Attest W R Forrest or Ferris Clerk
