TERRITORIAL ENTERPRISE

Convalescent.

John Connerton's foot is getting better and he is liable to travel about on it all right again next week, although he has rheumatism in the right arm and a felon or two coming on his left. Otherwise, John is progressing all right.

Jack Plant, foreman of THE ENTERPRISE, who has been housed with a touch of the grippe the last three or four days, will be able to be on deck again tomorrow.

MRS. M'GURN'S WINDFALL.

Joshua Hendy's Will Left No Doubt as to His Intention in Disposing of His Worldly Effects.

With regard to the Joshua Hendy will contest, the San Francisco BULLETIN of Wednesday evening says:

"In the Probate Court this morning the contest of the will of the late Joshua Hendy, who left a large portion of his $700,000 estate to his niece, Mrs. M.F. McGurn, was dismissed and upon proof of its genuineness the will was admitted to probate. The contest was withdrawn in pursuance of an agreement to compromise, the terms of which were not made public in court. The contest was begun by Mrs. Josephine Green, another niece of the deceased, who charged that Mrs. McGurn, her cousin, had unduly influenced Hendy to practically disinherit her. For some years before his death, she alleged, he had often declared that Mrs. Green was to be his heiress, but upon his death he left her a paltry $5,000. It is understood that the legatees have agreed to settle with Mrs. Green by paying her legal expenses and conceding her one-fortieth of the estate, equal to about $20,000.

The will would have been a hard one to break, as it was entirely written by the deceased and signed by two witnesses a long time before his death, which took place at the age of seventy-five. Hendy was a native of Devonshire, England, and came, to the United States in 1830. He arrived in California in 1849 and was always an active business man. He founded the Joshua Hendy Machine Works at North Beach and was the owner of much valuable real estate. He never married, and his heirs-at-law were his brothers, sisters, nephews and nieces."

A CONTESTED WILL CASE ENDS IN COMPROMISE.

The Controversy Between Mrs. Green and Mrs. McGurn Will End To-day.

The Joshua Hendy will contest bids fair to end in a compromise between the litigants. Readers of the CHRONICLE will remember that on November 11th last Mrs. Josephine Green petitioned Judge Coffey to deny the will probate, as she intended to contest the codicil by which her cousin, Mrs. F.A. McGurn, was substituted as principal legatee in the place of herself as so described in her uncle's former will of 1888. Mrs. Green had long been her uncle's favorite niece, and until her marriage with T.C. Green of this city had been openly announced as his heiress by her uncle Joshua. Her plea was undue influence by her cousin, and the case was to have been brought for trial today, but for an intimation that a compromise might be effected. Negotiations have been opened, and it is expected that the necessary documents will be signed by the interested parties this morning.

The estate is valued at $700,000 and is comprised mainly in the wealthy business and premises of the Joshua Hendy Machine Works Company, situated at North Beach and on Freemont street, San Francisco.

Joshua Hendy was a native of Devonshire England and came to the United States in 1830, aged 12 years.

In 1849 he came to California, where, after many vicissitudes, he embarked in 1870 in the business which has grown to such great proportions. He died at the age of 75. He was the inventor of several valuable patents in ore feeders for stamping mills, the royalties from which yeld a handsome income to the business.

EL TEMBLOR.

A Very Significant Eathquake Spanish Expression.

Throughout the newspapers of the Pacific Coast, especially during the present earthquake boom, the word, 'temblor' is frequently seen in descriptive mention of the peculiar phenomenal earthquaking disturbances and resulting damage to human superstructure. Temblor is simply a Spanish word, which, in this connection, signifies a shaking or quaking of the earth's surface. Its English signification is also given in the Spanish dictionary as "involuntary motion proceeding from fear or weakness," analagous to trembler or trembling in American language. Strictly interpreted, "el temblor de la tierra," is the trembling of the earth. Earthquakes of greater or less force and effect are historically reported throughout the Spanish countries of the Pacific Coast and California, makimg the word "temblor" very familiar with all old residents, as well as with subsequent population. El temblor has not been a very destructive guest or visitation on the Comstock thus far, yet "quien sabe" -- who knows what might happen?

Funeral of James Murphy.

The remains of James Murphy were laid to rest this afternoon. The funeral took place from the Catholic Church. A large number of members of Storey Lodge No. 3, A.O.U.W., preceded the hearse, and the line of carriages which followed the remains to the grave was an exceedingly long one.

James Murphy, who died of lockjaw early yesterday morning, was a resident of the Comstock for a good many years and had many friends here who sincerely mourn his untimely demise. He leaves a mother, sister and a brother in this city, besides other more remote relatives. He was a member of the Young Men's Institute, Miners' Union and of Storey Lodge No. 3, A.O.U.W., and was insured in the latter organization for the sum of $2,000. Deceased was a native of Bangor, Maine, aged 37 years. The funeral will take place tomorrow afternoon.

EVENING CHRONICLE VIRGINIA CITY, NEV. WEDNESDAY...JUNE 8, 1892

Bicyclists from the Bay.

Today a party of bicyclists, composed of A.J. Storey, C.N. Langton, A. Barnes, Chas. Dietle and G.T. Andrews, members of the Bay City Wheelmen, arrived in Virginia on Pneumatic Safety Bicycles, from San Francisco. They left the city on the 31st of May, making the trip leisurely and stopping where night overtook them. The came by the Yuba Pass to Truckee, thence to Tahoe City and crossed the lake on the boat to Glenbrook, then on down to Carson. The trip was made from Carson to this city in three hours. They report considerable snow on the summit of the Sierras and much hard traveling. The party will leave for Carson this evening, and begin the return trip from there to San Francisco tomorrow morning, going by way of the Placerville route.
