Sir,

I have the honor to transmit herewith copy of contract for wheat made at Hoopa Valley in February and mentioned in my report of April 1st 1865. Accompanying are copies of the bond, the notice for proposals, the bid, the oath of allegiance of contractor, and my affidavit.

Articles of Agreement entered into this eighteenth day of February, eighteen hundred and sixty-five between Austin Wiley Superintendent of Indian Affairs for California of the one part and A. Norton of Hoopa Valley, County of Klamath, and State of California of the other part.

This agreement witnesseth that the said Austin Wiley for and on behalf of the United States of America and the said A. Norton for himself his heirs executors and administratiors have mutually agreed and by these presents do mutually covenant and agree to and with each other as follows, [viz?]:

First. That the said A. Norton shall deliver at the Hoopa Reservation wheat of a good and marketable quality in such quantities as may be from time to time required for issue to the Indians not to exceed in the agregate forty thousand pounds and at such place and on such days as the Indian Agent in charge may direct. This contract to be in force for six months or such less time as the Commissioner of Indian Affairs may direct commencing on the eighteenth day of February eighteen hundred and sixty-five.

Second. That the said A. Norton shall receive the equivalent of six and two-thirds cents per pound in gold coin for the wheat accepted under this contract.

Third. Payment shall be made quarterly for the quantity of wheat accepted but in the event of the Superintendent of Ind. Affs. being without funds to pay for it then payment to be made as soon after as funds may be received for that purpose.

Fourth. In case of failure or deficiency in the qual or quantity of the wheat stipulated to be delivered then the Supt of Ind Affs or Indian Agent in charge of the Reservation shall have power to supply the deficiency by purchase and the said A. Norton will be charged with the difference of cash.
