Junior Sophisters only shall be eligible Sec 6th It shall be the duty of the Vice President to act in all the capacities of the President in case of his absence. Sec 7th There shall be a common Secretary; who shall also serve as Librarian: to which office Senior Sophisters only shall be eligible.-- Sec 8th It shall be the duty of the Secretary to keep a regular journal of all the proceedings of the common Society, to read all letters, resolutions and writings laid before the Society, to call the names of the members at the opening & close of each meeting, to transmit the names of the delinquents to the Judicial Committee of the Common Society, and also to give any member a dismission who may request it & present a receipt from the Collector of the full paymentof his bills. Sec 9th It shall be the secretary's duty as Librarian to keep an exact account of all books taken from and returned to the Library, to assess all fines for damages done them, and for not returning them in due season as prescribed in the laws and to transmit the same to the Collector. Sec 10th It shall be the duty of the Librarian, when any book or books shall have been newly received, to announce them within one week, by inserting their names in the blank leaves of [three?] catalogues Sec 11th There shall be a Treasurer, to which office Junior Sophisters only shall be eligible. Sec 12th It shall be the duty of the Treasurer safely to keep all money and property of the society and to pay out such sums as the Presidential Committee shall direct. To establish order, to promote improvement, and useful knowledge, and to render serviceable every advantage which may be presented to us; We, the members of the Philoma thesian Society in Mid dlebury College have adopted the following

Constitution Article I [In margin] Sec. 1 If the organization of the Society

[In margin] Name of the Society

The philomathesian Society shall be composed of such persons only as are members of College.

[in margin] Mem= bers, on what condi tions ad= mitted

Sec 2nd. Each student upon admittance into the Society, shall pay into the treasury thereof such sum, not under twenty five cents, nor over five dollars, as the Society shall be Law require; and also a sum not less than twenty five cents, not over one dollar, at the commencement of each succeeding term, during his residence in College.

Sec. 3rd [in margin] Meetings when to be held The society shall assem= be once, at least in each week; and such meetings shall be on Wednesday, at such

3 such hour as shall be by law fixed.

Article II Of election of officers, and their duties

[in margin] Presi dent, who eli gible

There shalll be a president to which office senior soph icters only, shall be eligible.

[in margin] his duty It shall be the duty of the president, to maintain order in the society, to put to decision all questions, motions &c which may arive; to criticise all compositions, and decla= mations which may be exhibited in the Society; The President may call extra meetings.

Sec. 2nd [in margin] Vice president who eligible There shall be a vice presi dent, to which office Junior sophisters only shall be eligible

4. [in the margin] Duty In the ascence of the pres= ident, the powers, and du= ties of that office shall divolve upon the vice president.

Sec 3rd [in margin] Secretary who eligible

There shall be a secretary to which office senior, ot Jun= ior sophisters only, shall be eligible.

[in margin] His duty

It shall be the du= ty of the secretary, to keep a correct Journal of the proceedings of the society; to lay before the Judi= cial committee all instan= ces of neglegences; and to do all other business whi= ch the society may direct.

Sec 4th [in margin] Librarian who eligible There shall be a Librarian, to which office, seignior, or Junior sophisters only shall be eligible; whose duty shall be prescribed

5 by the laws regulating the Society Library.

Sec 5th [in margin] Treasurer who eligible There shall be a Treasurer, to which office senior & Junior sophisters only, shall be eligible.

And it shall be the duty of the treasurer, to safely keep all money of the society; to pay out such sum, or sums from time to time, as the Society shall direct, and of the close of each college term to lay before the society a regular statement of all receipts, and expenditures for that term. The treasurer shall be accountable for all money committed to his keeping.

chosen at the last meeting in each College Term, for the next succeeding Term.

Sec 6th

[in margin] Judicial Committee who eligible

There shall be a Judi= cial Committee, consis= ting of three members, to which office Segniors, Juniors and Sophmores only, shall be eligible; viz, one Chosen from the senior Class, one chosen from the Junior Class, and one from the soph= more Class.

[in margin] Their power

The power of the Ju= dicial committee shall extend to all caes in law and equity, arising under this Constiution and the laws of the Society.

Sec 7th

[in margin] Presidential Committee who eligible

There shall be a Presiden= tial Committee, to which office, Senuiors, Juniors, &

7 Sophmores only, shall be eligible viz, one from the Senior, Class, one from the Junior Class, and one from the sophmore Class.

[in margin] Their duty

It shall be the duty of the presidential Commit= tee, to select books for the Society library, when di= rected by the society, to receive or refuse books which may be presented to the Society, and with the Librarian, to make all necessary regulations for preserving the Library, and keeping the same in repair.

[in margin] Committees when to be chosen

The foregoing committees, together with the Librarian, shall be chosen at the last meeting of the society, pre= ceeding every commence= ment, for one yearensu= ing.

Sec 8th

[in margin] Perma= nent elections when to be made.

All permanent elec= tions shall be made at the times hereto= fore mentioned, when no other business shall be done in the Society, except that for which the Constitution makes particular provision.

Sec 9th [in margin] Vacancies how filled.

If, from nonaccep= tance, or want of suf= ficient members in any Class, to fill the offices appropriated to that Class, such office, or offices, if the deficiency happen in the Senior Class, shall be filled from the next succeeding class, or classes, if in the Jun= ion Class, so much of

9 the deficiency as can shall be made up from the Senior Class, and the remainder from the next succeeding Class; and if the deficiency happen in the sophmoroe Class, so much of the de= ficiency as can, shall be filled from the preceeding Classes, and the remain= der from the succeeding Class.

Sec. 10th

[in margin] Permanent elections shall be by ballot & a ma= jority to make a choice.

All permanent elections shall be by ballot, and a majority of the whole members present shall be necessary to make a choice.
