A Bill to be entitled an act to incorporate "the Baptist Female University of North Carolina."

Section 1. The General Assembly of North Carolina do enact, Heat L L. Pold, C. A. Rominger, W. R. Gwaltney, R. R. Overby L. H. Pritchard. J. D. Hufham, R. T. Vann, N. B. Broughton, R. J. Mo[?]sh, A. G. Mc Maunaway, H. W. Bottle, C. Durham, J. W. Carter, B. Cade, G. W. Greene, W. C. Petty, E. K. Proctor, Jr., J. M Currin, J. H. Lassiter, W. G [?]bruch, W. L. Faircloth, R. P Thomas, D. F. King, Char. E. Taylor and J. L. Cohite, trustee, and their successors he and they are hereby declared to be a body politic and corporate for the herefore of providing for the higher education of female, under the name and style of "the Baptist Female University of North Carolina" and by that name and style they shall have perpetual succession and shall be capable in law to take, receive, hold and purchase all manner of land, tenements, rents and annuities and other hereditaments which at any time may be granted sold or ortherwise conveyed to the said corporation and and shall also be capable in law to take, receive and forces all moneys, goods and chattels, that may be given, sold or bequeathed by any reason or reasons for the use of said corporation and apply the same according to the will of the donors, all the aforesaid lands tenements

and personal property the said corporation shall have hold and use to carry out the purpose of the said corporation.

Section 2 That the said corporation shall be capable in law to bargain, sell and convey to any purchaser or purchasers such land ten ements and hereditaments and personal property which may be owned by said corporation as aforesaid when the conditon of the grant to the said corporation does not forbid the same, and the proceeds arising therefrom shall be held and used for the benefit of the said corporation

Section 3. That the said corporation shall have power to make and establish such by-laws rules and regulations for the government of the aforesaid University or to them may seem necessary, provided the same are not in conflict with the constitution and laws so of the State and the United States.

Section 4. That the said corporation may sue and be sued, plead and be unpleaded in all the County, and shall have power to make and use a common seal with such device and inscription as the aforesaid trustees may think proper

Section 5. That the trustees of the said corporation as named in section one of this act shall be divided into three classes, and the first nine

named of the said trustees shall hold their office for two years, and the next eight shall hold their office for four years, and the next eight names shall hold their office for six years but their successors shall hold their office for six years, and be elected by the remaining trustees.

Section 6. That no person shall be eligible to membership among said trustees unless he shall be a member of a Baptist Church That whenever any of said trustees above provided shall die resign, remove their residence to another state, refuse to act or shall fail to attend the meetings of said trustees continously for the space of two years the membership of said trustee shall be considered vacant, and the remaining trustees shall fill the vacancy

Section 7. That the said trustees shall have the power to remove any one of their number for improper conduct of which they shall be the judges, provided the cause thereof shall be entered upon their minutes, and provided further that the accused shall have thirty days notice of the proceedure and a majority of two-thirds of the members present shall be necessary to effect such removal and provided further that at such trial a majority of the whole Board of Trustees shall be present.

Section 8. That the said trustee shall have power to appoint their own president, secretary and treasurer for such time as they may deem best and to elect such professors and tutors and other officers of the aforesaid University or they shall deem qualified to discharge the duties of their several offices, and may remove the same for misbehavior, inability or neglect of duty or other cause which shall deemed advisable to said trustees and do any and all acts usually given trustees of literary institutions.

Section 9. That the said trustees shall hold their meetings from time to time or often as necessity may require and nine trustees shall constitute a quorum for the transaction of all kinds of business

Section 10 That the faculty of the aforesaid University by the advice and consent of the aforesaid trustees shall have power to confer all such degrees and [marks?] of literary distinction as are ususally conferred by colleges and universities.

Section 11 That the amount of real and and personal property held by said trustee shall not at any time exceed the sum of one million dollars, and the same shall be exempt from public taxation.

university shall be located in or near the city of Raleigh County of Wake State of South Carolina

Section 13. This act shall be in force from and after its ratification.
