{H.A. Smith} The State of Alabama, } In the Probate Court,
{Deceased,} Shelby County, } Special Term, Mch 7th 1896
{Est. of,} Present, the Hon D.R. McMillan Judge

In the matter of the estate of
{Order granting} H.A. Smith, Deceased--
{Letters Testamentry} And now on this day comes C.W. O'Hara and
presents to the Court, his petition in writing,
under oath, praying that Letters of
Administration with the will annexed on the Estate of
H.A. Smith, deceased, issue to him which petition
is examined by the Court and ordered to be filed
and recorded; and it appearing to the Court from
the allegations contained in said petition, and
from other good and sufficient evidence, that
the said H.A. Smith, departed this life at
Columbiana on or about the 26th day of July
1890, being at the time of his death an
inhabitant of Shelby County, Alabama; that he
died leaving assets in this state, which assets
both real and personal, are estimated to be
worth about One Thousand dollars, leaving a
Will and testament relating to the disposal and
distribution of his estate, and that the will of the
said decedent, has been duly probated in this
Court, and that J.S. Leeper, D.R. McMillan and
WB Browne who were named as executors of
said will, have declined to serve as such--
And it further appearing to the satisfaction of the
Court that C.W. O'Hara the said petitioner is
over 21 years of age, an inhabitant of this state,
and a fit persin, under the law and in the
estimation of the Court, to serve as Administrator
with the will annexed and no person having
appeared to oppose the granting of Letters of
Administration with the will annexed to the
said C.W. O'Hara or to show cause why the prayer
of said petitioner should not be granted, provided
that the said CW O'Hara first file in this
Court his bond in the pinal sum of Two
thousand Dollars, conditioned and payable
according to the Statute in such cases made
and provided, with such security or
securities as may be approved by the Court, It is
further ordered that the said petition be
recorded. And now again comes C.W.
O'Hara and presents to the Court for approval
his bond in form as by this Court heretofore
