Deed for Mississippi lands with slaves attached, owned by Leonidas Polk and A. Hamilton Polk and wives, Bolivar County Plantation, to James H. Yerger and Miles and Adams. 8 pp.

This Indenture made and entered into this twenty first day of February AD 1855 between Leonidas Polk and Francis A Polk, his wife of the City of New Orleans and State of Louisiana and A Hamilton Polk and Emily Polk his wife of the County of Bolivar and State of Mississippi parties of the first part, James H Yerger of the County of Washington and State of Mississippi of the Second part, and William B Miles and Daniel W Adams of the City of New Orleans and State of Louisiana partners in trade under the name and style of Miles & Adams of the third part, Witnesseth, That for and in consideration of the sum of ten dollars by the said party of the second part to the said parties of the first part, in hand paid, the receipt whereof is hereby acknowledged, and for the further considerations hereinafter mentioned _ The said parties of the first part have bargained, sold, aliened, conveyed and delivered and by these presents do bargain, sell, alien, convey and deliver unto the said party of the second part, his heirs or assigns, all that certain tract or parcel of land, lying and being in the County of Bolivar and State of Mississippi and known and described as the South half of Section Eighteen, The south west quarter of Section Seventeen All of Section nineteen, All of Section twenty, all of Section Twenty one, except one hundred and sixty acres, owned by Dr. Thomas S Polk, The North west quarter of Section

Alston aged about thirty eight, Lucina aged about thirty five, Leander aged aobut ten, Irvine aged about eight, John Lewis aged about sixteen, Winney aged about eighteen, Mary aged about sixteen and Henry aged about fourteen years, [strikeover] aged about six [/strikeover] together with their increase; To have and to hold the said lands and negroes unto the said party of the second part his heirs, and assigns for ever And the said parties of the first part do covenant with the said party of the second part to warrant and forever defend the title to the said lands and slaves free from the lawful claims or demand of all persons whomsoever*. This conveyance is in trust and upon condition, nevertheless, That whereas the said parties of the first part are indebted to the said parties of the third part for money advanced and loaned to pay for the said tract of land, plantation supplies &c as evidenced by certain drafts or bills of Exchange drawn by the said L & A. H Polk upon and accepted by the said Mills & Adams as follows to wit, one draft dated December first Eight een hundred and fifty four to their own order due October fifteen Eighteen hundred and fifty five for Four thousand one hundred and thirty four dolars and sixty two cents, One draft of same date to their own order due November fifteenth Eighteen hundred and fifty five for Four thousand One hundred and eighty five dollars and thirty four cents, and one draft of same

date to their own order due the fifteenth December Eighteen hundred and fifty five for Four thousand two hundred and thirty five dollars and sixty five cents. One draft dated December eighteenth, Eighteen hundred and fifty four, payable twelve months after date to the order of Parker Craig for Two thousand nine hundred and sixteen dollars, One draft dated February Seventeenth Eighteen hundred and fifty five payable twelve months after date to their own order for Two thousand nine hundred and eighty seven dollars and six cents, One draft dated February seventh Eighteen hundred and fifty five payable twelve months after date to their own order for Three thousand five hundred [strikethrough: and fifty seven] Dollars, and one draft dated this twenty first February Eighteen hundred and fifty five payable twelve months after date to their own order for Three thousand nine hundred and fifty dollars, and also are indebted to the holder of a certain promissory note bearing even date herewith for the sum of Five thousand dollars due and payable twelve months after dat at the Canal Bank of New Orleans, all of which with any and all amounts of money that may be paid and supplies that may be furnished said plantation hereafter by the siad Miles and Adams, or drafts by the said L.&AH. Polk that may be drawn on and accepted or paid by the said Miles & Adams it is the desire of the said L & A.H Polk more affectionately to secure
