title interest or trust of and in the same and doth hereby fully freely and
voluntarily declare and make known to all person or persons whomsoever it
doth or may concern that all the Estate right title or interest claim or
demand whatsoever as well legal as equitable of him the said Thomas
Potter Macqueen his heirs executors or administrators of and in the said
Mortgaged Estate and premises shall from henceforth wholly cease and
determine to the intent that the same and every part and parcel thereof may
go to and vest in and belong to and be enjoyed by the said John Mac
Arthur who hath paid the said sum of one thousand one hundred and seventeen pounds four shillings and five pence
to the said Thomas Potter Macqueen as aforesaid and unto his Heirs
Executors Administrators and assigns provided always nevertheless and
it is hereby expressly agreed and declared by all the parties to these presents
that nothing herein contained shall in any wise lessen weaken diminish and
make void or voidable or be construed to lessen weaken diminish or
make void or voidable the said charge Mortgage debt and Securities
from the said Thomas Icely to the said John Mac Arthur and which
in favor of the said John Mac Arthur his heirs executors administrators
or assigns are hereby declared to be in full force effect and virtue any
thing herein contained to the contrary in any wise notwithstanding
In Witness whereof the said Thomas Potter Macqueen John Mac Arthur
and Thomas Icely have hereunto interchangeably set their hands and
Seals the sixteenth day of July in the year of our Lord
one thousand eight hundred and thirty and in the first year of the
