the said Estate of Boon-Garibee [Bungarribee] with Interest at the rate of Ten pounds per Cent
per Annum And Whereas a Mortgage Security for the Sum of one thousand
pounds with interest at ten pounds per Cent per Annum was accordingly executed to
the said John Mac Arthur by the said Thomas Icely shortly before the departure
of the said Thomas Icely from the said Colony in the commencement of the
present year And Whereas the said Thomas Potter Macqueen hath expressed
his wish to relinquish the benefit and advantage of the last mentioned Mortgage
Security and to receive the amount now due to him in respect of the said
Sum of Eight hundred pounds and interest thereon And Whereas the said
John Mac Arthur hath consented to hold the said last mentioned mortgage
for his own use and benefit and to pay to the said Thomas Potter Macqeen
the sum of one thousand one hundred & seventeen pounds four shillings and five pence in full satisfaction and discharge
of the amount now due to him and thereupon the said Thomas Potter
Macqueen hath consented to execute these presents and to declare and make
known that upon payment to him of the said Sum of one thousand one hundred and
seventeen pounds four shillings and five pence in full for all principal money and interest due to him in
respect of the said Sum of Eight hundred pounds so advanced by him as
aforesaid upon the said Mortgage Security all the Estate right title or
interest claim and demand whatsoever of him the said Thomas Potter Macqueen
his heirs executors or administrators as well legal as equitable of and in the
said Estate and premises called the Boon Garibee [Bungarribee] Estate and the mortgage
thereupon shall from henceforth cease and determine and the said Mortgage
Security and every Covenant Condition proviso and agreement therein contained
so far as respects him the said Thomas Potter Macqueen his heirs executors
administrators or assigns shall thereupon in like manner wholly cease and that
the Same and all benefit and advantage thereof and all Interest as well
legal as equitable of and in the same shall go to and belong to and vest in
the said John Mac Arthur his heirs executors administrators and assigns
Now Know Ye that the said Thomas Potter Macqueen for and consideration
of the Sum of one thousand one hundred and seventeen pounds four shillings and five pence
of lawful money of Great Britain to him in hand well and truly paid by the
said John Mac Arthur at or immediately before the sealing and delivery of
these presents the receipt where of the said Thomas Potter Macqueen doth
hereby admit and acknowledge and that the same is in full for all prinicipal
money and interest due to him upon the said Mortgage Security of the
said Boon Garibee [Bungarribee] Estate as hereinbefore is mentioned and of and from the
same and every part thereof doth hereby absolutely acquit release exonerate
and for ever discharge the said John Mac Arthur his heirs executors
and administrators also the said Boon-Garibee [Bungarribee] Estate and every part and
parcel thereof and all other person or persons whomsoever of and from
the payment of the said Sum of one thousand one hundred and seventeen pounds four shillings and five pence
for ever by these presents so far as he may have or possess any right
