the cash book April 21 1875 for moving the safe. Now was there any safe taken up to Colton's house? Did he have any safe in his house?

A No Sir, not that I was ever aware of. If he bought another safe from any other place I know nothing about it. I can only say if I entered $400 against the Company for a safe. I did it by his order.

Q At that date?

A Yes Sir wherever it went I do not know anything about that.

Q Didn't you have a safe in the R M C & I Co?

A Yes Sir. He bought a safe off Tillman.

Q You had it in the R M C & I Co?

A Yes Sir, all the time.

Q Where did it go to from there?

A To the R. R. office.

Q And when he moved it down he charged it as if it was a new safe.

A That explains if then. I know nothing about it. Tillman's men moved it, put it up about the first of July and took it down and moved it to the R. R. office.

Q If that was charged to the R M C & I Co at that time, it was a steal, was it not?

A I do not know what it would be legally.

Q What would say it was morally?

A I could call it a clean steal. We had only one safe, and that was the one.

Q When he moved down to the R. R. he took the safe down there?

A The same safe went down there because Tillman's men moved it out of the

Q D 56. C. P. Huntington $1160.66 C. P. Huntington explains that this money was remitted to him for some money which Colton borrowed of him in New York to do some shopping. What you know about it?

A Only that he ordered me to go and get a gold draft. I think I went to the bank of California. I am not sure but I think I went to the Bank of California and I got a gold draft for C. P. Huntington for $1160. and paid the expenses of the draft and came back and gave it to Colton in the office.

Q He told you to get a check for C. P. Huntington?

A Yes Sir. He told me to get exchange for C. P. Huntington

for $1110 in gold. That is my recollection of the transaction. I got the Exchange and brought it up to him and gave it to him or laid it on his desk. He did not explain it to me what it was for.

Q He did not explain it but merely told you to remit to C. P. Huntington?

A He told me to get exchange for $1100 in gold which I did.

Q D 57 February 24. 1874 Cash to mine to make good error in draft No. 645 $5." What can you say about that?

A I recollect about the transaction about his writing that it was short.

Q Do you remember what you did about it?

A No Sir. I cannot, any further than if I gave the money to Colton to pay it. I cannot say. I must have

Q It appears as if you made a memorandum as if you had sent it to Beeman and Beeman says he never got it. Now D 58, paid to Roman, Cryptograph $10.

A I recollect buying the cryptograph of Roman on his order.

Q Why would you want two?

A I do not know. I cannot tell you. It was his order for me to go and buy one, and I do not know what use he made of it or what he did with it.

Q This man says that one of those was used in Colton's stock operations with Latham. Do you remember what was done with that?

A No Sir. I do not.

Q You do not know whether Colton used them for the Company or for his own private
