A I cannot say anything about that without I could refer to the books.

A D 47. Under date March 20 1872 Cash from F. Chappelet for coal H. K. White $38.97. There is a charge on the cash book, amt. to H. K. White $38.97. What can you say about it?

A Well I guess that is correct. I guess I received the money from Chappelet.

Q Well, what became of the money received from Chappelet? There is no showing what became of the money.

A I must have put it in the drawer, the same as I did the money received from Rice and deposited it in the bank. I am positive of that.

Q D 48 April 5, 1872 Cash from L. G. Rice & Co all sales. H. K. White $50?

A Yes.

Q That is an entry in the cashbook, and to H. K. White $50. A That is correct That went the same way as the other. I will explain it this way. Sometimes we would receive as small an amount as $20 for a car of coal from different parties in cash and I would put it in the drawer and when I got an amount I mentioned as I told you before, $50, or $100 or sometimes $200 gold I would go and select out from the drawer all the gold there was and make a deposit of[scribbled out] with other money that I had on hand. I always notified Gen Colton whenever I received any money, even the smallest amt. for coal and who I received it from.

Q How did you notify him?

A Telling him that I had received certain money from certain parties.

Cash paid E. C. Kennedy $71.75 There was no voucher for that.

A I think that must have been for office furniture. I do not know what "it is"[scribbled out] else; I think Kennedy was a furniture man.

Q For whose office?

A For the Coal Co. office.

Q The Coal Co office was kept in Colton's office was it not? A Yes.

Q Did not Kennedy supply furniture to Colton for other purposes than for the Company?

A I could not say — I do not recollect.

Q You do not know that that was furnished the Company? A No sir I could not say positively.

Q The Expert thinks it was not?

A Well I know that when the office was broken up I t hink all the furniture was

Q You are sure of that, are you?

A Yes sir I know because I had it moved down.

Q D 50 April 14. 1873 Pioneer Furniture Warehouse $24. It would seem as if that was furniture received which had to be stored. That was about the time that Colton was furnishing his house, 1873. Might that not have been furniture received from New York which he was not ready for?

A No sir. I think not. I think this was for some furniture in the office, and my impression is not that it was a hat rack put in the office. That is my recollection or impression. It is so long ago.

Q D 51. July 31. 1873 Gold draft 353. 354. $589.40 each, amounting to $1178.80. The charge here is that the payments were not for account

A Well it must have been drafts that Gen Colton ordered me to draw checks for. I cannot say what they were for. They were not from the mine. I cannot give any explanation of that.

Q It appears there were checks drawn for them but no ex= planation what they were for. They read in each case in the stub books that they are cash for R M C & I Co, but there is no voucher, and no purpose explained where that went to. Can you say why you entered these things in that blind way?

A No Sir.

Q Instead of saying in the checkbook what they were for.

A No Sir. If Gen Colton had explained to me or tolD me what they were for, of course
