The State of Alabama } To any Sheriff of the State of Alabama Shelby County } You are hereby commanded to notify John W Florey Henry E Florey and Edward Florey that at the Spring Term 1861 of the Circuit Court of Shelby County the following Conditional Judgement was rendered viz. The State of Alabama } Indictment for Murder 714 VS } Is appearing that the Defendant John W Florey } John W Florey Henry E Florey & Edward Florey entered into & made a recognizent as follows to writ. State vs John W. Florey charged with murder The State of Alabama } Know all men by these presents that Shelby County } We John W. Florey H.E. Florey & Edward Florey and held and firmly bound unto A.B. Moore Governor of the State of Alabama and his successors in office in the penal sum of one thousand dollars for the payment of which we bind ourselves our heirs & assigns jointly & severaly by these presents sealed with our seals & dated this 25th day of Sept 1860. The condition of the above obligation is such that whereas the said John W Florney has been charged with the murder of a certain negro boy names Charles the property of Edward Florey and required by C.F. Elliott Justice of the Peace and James Bailey associate Justice of the Peace to appear at the next term of the Circuit Court for Shelby County and answer said charge and appear from day to day & from term to term until discharged by law. Now should said John W. Florey appear as so required this obligation to be void else to remain in full force and effect Signed Sealed and delivered this day & date above written. J.W. It is ordered that the State of Alabama for the use of Shelby County recover of the said John W Florey Henry E Florey & Edward Florey on such recognizance or undertaking as foresaid the said sum of one thousand dollars unless they appear at the next term of this court & show cause why this judgement should not be made absolute It is further ordered that a Scire Facias issue.
