Know all men by these presents that we Daniel Freeman and Mark Jones of the County of Stanly in North Carolina are held and firmly bound to the President and Trustees of the University of the State of North Carolina in the penal sum of Five Hundred Dollars for the payment of which well & truly to be made we and each of us bind ourselves & each of our heirs jointly & severally firmly by these presents - sealed with our seals & dated this 9th day of March 1855.

The Condition of the above obligation is such that whereas Daniel Freeman has instituted an Action of Ejectment in Stanly Superior Court of [?] Doe on the Several demises of himself & others against Willie Hatty & William Hatty for the recovery of a tract of land to which said Freeman claims titile - And oweing to the destruction of the Records and Registers Books of Montgomery County by fire, and loss of a material title Paper - it becomes necessary for said Freeman to lay a Demise in the name of the President & Trustees of the University of North Carolina in his Declaration in said action - Now if the said Daniel Freeman shall fully indemnify and have harmless the said President and Trustees of the University from all liability & from all costs & damamges by reason of using & laying a demise in their name, and carrying on said action with their name as Lessors of the Plaintiff - and in every respect have said University & Corporation harmless on account of their name being used as aforesaid Then & in that case the above obligation to be void - otherwise to remain in full force.

I am willing to accept the appointment of agent and attorney of the board of Trustees of the University of North Carolina for the County of Wilkes and act in accordance with your commision dated 1st March 1855.

I have received yours of the 1st inst postmarked 6th and beg leave to thank you for this renewal of my old commission as the attorney of the University of N.C. within the County of New Hanover - With the promise of increased zeal in the service of my old alma mater, and with the hope that these services may not be fruitless, I am with much respect & esteem.
