Washington N.C. Aug 1st 1855 Charles Manley Esq.

Sir, I feel myself [compelled?] to Write to you concerning (John G Watler) my deceased husband's property which it seems the University wishes to take from me. My husband was a Naturalized Citizen of the United States which can be proved by refering to his papers or to the Court house here in Washington. When I married him what money I had and his together were spent to buy this property he also borrowed money from Benj F Havens Esqr to finish to pay for this property for Which the said Benj F Havens Esqr had a Claim of several hundred dollars for security of his Loan. My present husband (John G Buxbaum) paid the said Benj F Havens Esqr the sum owed him on the property and took the Claim as a liquidation of the debt, he J G Buxbaum my present husband has made several improvements on this property now I and my present husband to loose all the money we have expended on this property if so I do not know what is to become of me for it is all I have in this world.

[Nov. 5, 1855]

Be it ordained by the Trustees of the University of North Carolina, and it is heareby ordained by the authority of the same,

1st that from and after the beginning of the present Collegiate year, whenever the receipts from tuition and room rent shall amount to or axceed the sum of Tweleve thousand Five Hundred Dollars , the President of the University shall recieve the sume of two thousand two hundred dollars , the Professor of Chemistry Twelve hundred and fifty dollars, the professor of Mathematics and Natural philosophy, the Professor of theGreek Language and Literature , and the Professor of the latin Language and Literature sixteen hundred and fifity dollars each: the Professor of History fifteen hundred and fifty dollars, the Professor of Rhetoric and Logicthirteen hundred and fifty dollars, the Professor of birth Engineering and the Professor of Agricultural Chemistry fourteen hundred dollars each, the Adjunct Professor of Latin andGreek tweleve hundred dollars, Tutor pool eight hundred dollars, and Tutors Lucas, Battle, and Wetmune seven hundred dollars each.

2. The President, the Prof of Chemistry, the Prof of Mathematics and Natural Philosophy, and the Prof of Rhetoric and Logic shall continue in the side and occupant of their several residences as heretofore. 3. That the compensatino of the Bursar shall be so regulated that the prerequisites of the Professdor who shall discharge the duties of the office shall not exceed that allowed to the President of the University. 4. The the division of the classes and scale of dutities is arranged at the beginning of the present session is hereby confirmed and shall be maintained and faithfully observed by every member of the Faculty. 5th. That if at any time bereafter, the amount of tuition and room shall be less than the sum of twelve thousant five hundred dollars, then and in that case, these several ordinances shall become null and void, and the salaries of the several memebers of the Faculty and the duties to be respectively performed by them shall be the same that were recieved and performed during the last collegiate year (1854-1855).

Sir. I have the honor to make the following Report of the progress and condition of the case of the University & [?] [?] and Nicholas W. [?] Executor of the last will and testament of Rachel [Atkin?] -son, deceased.

At the August term of the County Court of Nash, pursuant to the terms of my Commission dated the [?] March 1855, and of your special order of the 27th of that month I pled the carrat & carried the [?] above described to be entered.

Upon yesterday, the Jury entered a [?] in favour of the University, [Under?] the circumstances which communicated to you in person immediately upon my arrival here, there is hardly any doubt that this [?] will be undisturbed, by the judgement of the [?]

to me and I can only hope it will to the Trustees. By that [Bucksbaum?] & wife will have paid $959 for property worht $1400, which they believed to be theirs and which by an equity so plain as to be recognized at the least by the Legislature of Virginia and the Congress of W.S. ought to be theirs. Do me the favor to present their case to the indulgent consideration of the Trustees: the parties are poor - ignorant of our laws - will feel hurt by what they may concieve to be injustice & will feel grateful for kindness.

The parties as I have said are too poor to litigate with the University & if the Trustees will not accept this offer they must lay down their terms_ we capitulate at discretion. Let me hear from you as soon as convenient.

Chapel Hill Jan 12/56 My dear Sir

Your favour calling my attention to the University debt has been received & I beg you to believe that your long continued Kindness & forbearance in this matter has affected me, as it ought to do. In regard to the payment required at this time I am grieved to say that it is wholly impossible. I resolved after I saw you at Chatham Court, to make any sacrafice to meet at least the interest & immediately offered my House & lots in This place for sale & had hoped at one time that I should certainly sell them as I had a positive prom =ise to that effect, but when the day came the person offer=ing said he found it impossible to raise the money – To annoy

you, my friend, with a recital of the hopes I have had blighted from time to time by the delay in the development of my Coal property on [Deep?] river & which I am now assured by the best authority will soon be of immense value, would be inexcusable, as it would be vain & there is nothing now left to me but to ask that you will no longer subject yourself to censure on my account, & that if you will bring a blank writ with you at Chatham Feb. Court, returnable to make Sep. Court next I will confess service of it – This is all I can do at present & if in the mean time or before final judgment I can sell either Coal lands negroes or House plots & which I am determined to do
