correspondence going on be-tween them and I not knowing anything about it.

Q I understand that what-ever correspondence took place between Beeman and Colton that you were not advised a-bout it?

A Well, most of it: I kept[crossed out] copied the letters. He would write his letter and I copied them into the copy book.

Q Always?

A I cannot say all of the correspondence of course, because he might have written letters that were never copied into the book.

Q Was there more than the letter book kept in the office?

A No sir I think not. We never had but one in the office.

Q But I say Colton's correspondence with Beeman, was every letter copied in the letter book?

A I think that was all yes sir.

Q Well then, if there were any such letters as I speak of written by Beeman to Colton complaining of the mine being starved, and the employees being unpaid for two or three months, you never saw such letters that you remember?

A No sir, not that I recollect of.

Q How do you account for the fact of you being there and those letters being received and the you did not see them.

A Well, as I said he always opening his own mail matters, if he received such a latter as that he could keep it to himself and I would not know any thing about it.

Q Did you ever know during the time that he had money on hand belonging to the Company. If his making the note if the RMC & I Co. and borrowing money upon them?

A I do not recollect this. My impression is that his notes were all individual notes put

Q Do you recollect on October 16 1876 that was at the time you were bookkeeper?

A Yes.

Q That Colton made a note of the RMC & I Co. to the order of the First National Gold bank in the sum of $30000 with interest at one per cent a month?

A I don't recollect this.

Q Did he ever tell you at that time in October 1876, that he had made such a note on behalf of the Coal Co?

A Not to my recollection, No.

Q I see there was not entry made on the books of the Company showing that it had been made. Can you recollect whether or not you made any entry on the books of the Company showing that such a note had been made or that the Company had been made liable by a note given by Colton?

A No sir. I do not recollect. I do not think I ever did.

Q Do you remember any meeting of the directors during the time you were secretary, giving him power to make such a note?

A No sir.

Q Speaking of the minute book of the Company. Was that kept by you during the time you were secretary?

A Yes.

Q State how you kept it, whether the proceeding recorded in that book were of matters that came within your knowledge as secretary, or whether they were dictated to you by somebody else?

A No meetings that were held in San Francisco I had orders from him.

Q From whom?

A From Colton: of course on the 5th of every month I think it was, the regular

meetings were held; and up to the time that he went to the R R offices the meetings were held there on Montgomery St in the building 402. Usually Col Gray, Harrison, Gen Colton and myself would be present. After that when he moved to the R R office, I do not think that there was any book ever present at any regular meeting on the 5th of the month excepting him and myself, possibly, Col Gray might have been at one time or a few times, but on the 5th I would go down to the office with my record book to his office, the R R office, and then he would tell me to enter in the record of the meeting held on that date at which a dividend would be declared.

Q where as no such meeting had been held?

A Whereas that was the
