A Without their being present, according to his orders.
Q In that time this note that I spoke of for $30 000 to the order of the First National Gold bank was made in October 1876, there was no meeting other than such as you have described?
A That was all of any meeting where any such matter came up.
Q Did you know during the time that you were the Secretary of this Company, that Colton kept any other bank account than the one with the London & S. F. bank?
A He kept a bank acct, with the First National Gold Bank.

Q At what time?
A Well from some time shortly after its organization I do not know how long, several years.
Q Were you Gen Colton's private bookkeeper?
A Yes Sir.
Q From what time?
A From the 1st of January 1871 when I went into the Employ.
Q Until when?
A Until he went into the R R Co.
Q That would be the last of 1874?
A Yes Sir when he moved down to the R R office. I no longer kept his private accts[underlined].
Q Who kept them then?
A I think Mr Green did.
Q Between the 1st of January 1871 and the last of 1874, did Gen Colton keep a bank account all that time with the London & S. F. bank?
A I think yes.

do with that?
A No sir.
Q Did you make deposits there?
A Yes Sir, I made deposits there for him and also in the First National Gold bank when he had a bank account there.
Q I am speaking of the First National Gold bank.
A Yes Sir: I made all his deposits.
Q Did you deposit any of the RMC & I Co money with the First National Gold bank?
A I think not. I think it all went into the London & S. F. bank. That is my recollection now.
Q Do you know any thing of a bank account kept by Colton with the London & S. F. bank entitled "Old Indebted= ness?"
A Yes Sir.
Q Any such account kept in his books?

A No sir, not that I know of. Not that I recollect of.
Q Was that account with the First National Gold bank opened when you became employed by Colton on the 1st of January 1871?
A My impression is that the Gold bank was organized after I went into his employ.
Q You cannot remember when that was started?
A I think it was after 1871. January 1st.

Q The next entry on that Exhibit D in "D 1". Salaries drawn. Did Colton at any time communicate to you the salary that he was to receive as president of the R M C & I Co?
A My recollection is that all I charged the company for him under his orders, salary at the end of every month.

of December 1871 you charged a salary for 1871 at $1200 a year. $100 a month. By whose orders did you make that entry?
A By his.
Q Did he tell you what his arrangements with the Company were?
A No sir, he never told me anything about it.
Q He instructed you to make that entry?
A He instructed me to make that entry.
Q After that you charged every month?
A Yes sir.
Q When the salary was increased from $100 a month in 1871 to $400 in January 1872, what did he say to you about that?
A He merely ordered me, he said to enter up his salary at so much.
