A Yes sir I recollect that much in regard to it.

Q I ask you the question was that collected by you?

A No sir I do not think I collected it.

Q Cannot you remember whether you did or not? It appears to be entered April 8, 1873, and it appears by your correspondence of January 1874 that it could not have been paid to you because you were then inquiring about it.

A Yes. I have no Knowledge of its being paid.

Q If it was paid in April 1873 you would not have been writing to know why it was not paid in January 1874.

A No Sir.

Q You have no Knowledge

where that $18 went to?

A No sir I have not.

Q If it was embezzled by anybody it was not by you?

A No Sir.

Q "D 4" The next Entry December 26 1873. "Central Pacific RR. Co. Refuse coal $92.70" What explanation can you give of that item?

A I cannot give any.

Q You have no recollection about it?

A No, Sir.

Q D 5. July 30 1874. Central Pacific R R Co. Allowance thi[scribbled out] $11,622.18 then paid in ? $1757 61. Balance $9,864.57 What do you know about that balance of $9864.57?

A I have no knowledge of that.

Q Calling your attention to the $1757.61 allowed. You have some knowledge of that, have you not?

A If that is the entry I have some recollection in regard to it. In that is the entry on the books to the credit of the Company.

That is the amount Colton ordered me to enter, $1757.61.

Q Have you any Knowledge of the difference between that amount and the $11.622.18?

A No Sir.

Q Did you ever know that on July 28. 1874 Gen Colton had presented to the Superintendent of the Central Pacific R R Co an account of $11.622.18 and had obtained an allowance upon it, and had presented the account so allowed to the treasurer of the company and obtained a check for that amount?

A I have no knowledge of it, Sir.

Q Do you remember ever making out such an account against the Central Pacific R. R.

A I have no knowledge of it now sir.

Q The amount that you say you received $1757.61 is shown in that account as an allowance for the month of May 1874

1874; the rest of the account is for allowance in preceding months. Had you any Knowledge that the Central Pacific R R Co had made such allowance for preceding months before May?

A No Sir.

Q When did you first hear of it; Was it before or after the commencement of this action?

A Since the commencement of this action.

Q How long ago?

A But a short time ago, a few days ago.

Q Look over a copy of the account presented to you. presented by Gen Colton, entitled "Central Pacific R R Co To R. M. C & I Co", and which is receipted "David D. Colton president" under date July 25th 1874, and see if you can recollect of any of these items claimed in that account.

A No sir. I have no Knowledge of that account. I do not think I ever saw it.

Q The last item you must have seen.

A The last item, if this appears in the Central Pacific R R Co account it is the amount that he ordered me to enter.

Q What item are you speaking of?

A The $1757.61.

Q The last item in the account shown you is in the month of May, 470 flat cars 1. 043. 500 pounds at 2 50 $1757.61 That is the item which it appears you entered upon your books.

A I think I could find that in the account. [It runs] in my recollection that that was the amount. I entered that at the order of Gen Colton.

Q Did you at that time have any knowledge that he had received any other amount in connection with that that he did not want entered?

A No sir, I had no knowl-
