H. K. White elected director to fill the vacancy. Do you remember that meeting when you were elected director?

A I think that meeting was held in the office on Montgomery St.

Q Was anything stated as to what the terms of the settlement were?

A No Sir. I do not recollect of any. It only occurs to my mind that there was such meeting at that time, but the terms of the settlement I do not recollect. No "term"[crossed out] statement were mentioned in my presence of any settlement.

Q Do you remember any thing about why that should be charged to the Company instead of to Colton?

A I cannot explain it any further.

Q Either the stock was bought for the Company, or it was bright for Colton; If it was bought for the Company what became of the stock?

A That $2500 was no doubt

Q What became of the stock if that went for stock?

A I never saw it. The stock from H. J. Rogers. I do not recollect that I ever saw any of it. That is, at that time. It might have been held by Colton.

D 37 to 45 [left margin]

Q D 37 to 45. The charge here is on December 8, 1877 paid for transmitting funds to A. R. Converse $7. Why was that money sent to Converse?

A Well, he held some stock I think. My recollection is that it was sent for the purchase of stock from Converse — that it was charges or money sent to him.

Q Do you know any reason why the Company should have paid that money?

A No Sir: that is an order of Colton to me.

Q You do not know any reason why it should be charged?

Q D 38. August 20 1871. Error in correction of US currency 1.03. The expert says this is a charge made to balance cash book. Do you know anything about that?

A No sir I do not.

Q You do not know why that error was made?

A No Sir. It must be some error in the currency ofc.

D 34 30.13 [left margin]

Q D 34 February 3: 1871 Purchase of currency $27.30. There is no explanation where that currency went.

A Well unless the stub of the check shows some explanation I cannot.

Q Do you remember I asked about the $30 credited to Colton that should have been charged to him?

A Yes.

Q The expert thinks that was connected with the same matter. Can you remember abut [about] it?

A No Sir I do not.

D 40 [left margin] Henry buyout [underlined on left margin]

Q D 40. Januanry 21. 1871. Check No 830 for $270. This charge is posted with the San Francisco ledger as Salary of Henry $270. His salary was only $250 in coin.

A Well he received his expenses besides.

Q You think it is probably for salary and expenses?

A Yes sir. It must have been a draft that he gave somewhere on the road, possibly Omaha or elsewhere, a draft on Gen Colton, it it was a Henry draft. He did sometimes draw money in that way.

Q You think that is for his salary and expenses?

A Yes sir. Probably expenses. My recollection was that he was to get $250 a month and his expenses as General agent while he was in the Employ of the Company.

Q D 41 Sept 1. 1871 Error in charging draft 30 cents. It appears

that there was a draft on Colton from Deuel for one amount and it is charged 30 cents more than the amount; that is all there is of it. I supposed that is an error, is it not?

A I suppose that is an error.

D 42 [left margin]

Q D 42. November 17. 1871 Paid Sisson Wallace & Co bal. of September payrolls $291.50. That was the balance of the money that should have been paid to them in Currency and it was deducted as gold?

A The difference yes, Sir.

Q And that check is for the difference?

A That is my understanding.

Q That is the "settlement"[crossed out] statement that you made to Mr Wilson about it? A Yes.

Q The check is drawn November 14. 1871 $291.50. Sisson Wallace & Co Balance of Chinese labor Sept for Co. That agrees also with the entry you made when you
