A. The incorporators acted as trustees.

Q. 26 Was any person elected president of that corporation immediately after its incorporation?

A. I think so.

Q. 27 Who was that person?

A. I have forgotten.

Q. 28 Was any person acting as secretary after the incorporation?

A. I presume so. I don't remember who was acting as secretary.

A. I think so.

Q. 30 Were you not that person?

A. I acted as secretary at one time; but whether I acted first as secretary I have forgotten.

A. I don't remember the date.

Q. 32 At what time did you cease to act as secretary?

A. I think it was sometime in 1873.

Q. 33 Can you state what time in 1873?

A. About the middle of the year.

Q. 34 How long before that time had you acted as secretary?

A. I don't remember the exact time.

Q. 35 How long altogether did you act as secretary?

A. Three or four years.

Q. 36 From the time of the incorporation of the Company in 1867 to the time you speak of in 1873 do you know of any person other than your= =self acting as secretary of that Company?

A. After its organization I don't know of any one — after two or three months.

Q. 37 Now I will ask you, Mr. Brown, whether, as secretary of that Company —

A. [Interrupting:] I will state here, I had forgotten the date of its organization. If it was in 1867, then my answer [to Q. 35] should be five or six years, instead of three or four years.

Q. 38 As such secretary did you have possession of the stock=book of the Company?

A. I did.

A. I think so.

Q. 40 Did you issue any of the stock of the Company?

A. I think I issued it. I was secretary of several companies, and do not remember partic= =ularly.

Q. 41 Did you issue any to yourself?

A. Whatever I subscribed for I probably issued to myself. I don't remember.

Q. 42 Where is the stock=book from which the stock was taken that you issued?

A. I don't know where it is.

Q. 43 When did you last see it?

A. I don't remember when I did see it last. I have not seen it for five years.

Q. 44 You have not seen it for five years?

A. Four or five years, I think.

Q. 45 Where was it when you last saw it?

A. I think in the office of the Company.

Q. 46 Was it in your custody as secretary?

A. Yes sir.

Q. 47 To whom, if to anybody, did you de= =liver it?

A. I did not deliver it to any one. I left

A. In the same building.

Q. 51 Was it an office communicating by a door with the office occupied by the officers of the Central Pacific Railroad Company?

A. It communicated with a hall by a door, and that hall communicated, by another door with the office of the Central Pacific Railroad Company, I think.

Q. 52 Who was the acting president of the Contract and Finance Company after its in= =corporation?

A. At what time? There have been sev= =eral presidents.

Q. 53 Who was the acting president in 1867?

A. I think it was Mr. Milliken or Mr. Crocker. I have forgotten.

A. Benjamin R. Crocker.

Q. 55 Who was the second president?

A. I think Charles Crocker succeeded him.

Q. 56 When did he become president, and for how long was he president?

A. I don't remember how long he was president.

Q. 57 Do you know when he ceased to be president?

A. No; I do not.

Q. 58 Was any other person president of the Company during the time that you were secretary?

A. Yes sir.

Q. 59 Who?

A. I think S. A. Hopkins was the president a portion of the time.

Q. 60 Mr. Cohen: Was not Mark Hopkins pres= =ident at one time?

A. I think not. I don't remember of his ever being president.

Q. 61 You do not recollect?

A. No.

Q. 62 To whom, if you know, did you issue certificates of stock of this Contract and Finance Company?

A. To whomever subscribed for it. I do not remember their names.
