A. I think there were several changes in the trustees. I don't remember when, or who they were.

Q. 98 Do you recollect any persons, who acted as trustees of the corporation during the term that you were secretary, other than those that you have heretofore mentioned?

A. I do not remember their names.

Q. 99 Was Mr. Charles Crocker a trustee?

A. He was president of the Company at one time.

Q. 100 Was he a trustee at the time he was president?

A. I think he was a trustee: I am not sure.

Q. 101 Was Mr. E. B. Crocker a trustee at any time while you were secretary?

A. I don't remember whether he was or not.

Q. 102 Was C. P. Huntington a trustee?

A. I don't remember that.

Q. 103 Was Mr. Mark Hopkins a trustee?

A. I don't remember that.

Q. 104 You say that the Company received moneys for the building of portions of the railroad of the Central Pacific. Will you state when the first payment was made?

A. Made to what?

A. Paid out again for labor performed.

Q. 107 Was it kept in your safe, or deposited in the bank?

A. Both.

A. We kept them at several banks.

Q. 109 Will you name them?

A. A portion of the time at the Bank of California; a portion of the time at the Bank of D. O. Mills & Company.

Q. 110 — Of Sacramento?

A. Yes sir.

Q. 111 Did you have an account with any other bank at Sacramento?

A. I think we had an account, for a short time, with the Capital Savings Bank. I am not quite sure.

Q. 112 At Sacramento?

A. Yes.

Q. 113 Did you receive from the Central Pacific Railroad Company, as consideration for building their railroad, or for any other purpose, anything besides money?

A. I don't remember of any ever coming into my possession.

A. The books of the Railroad Company?

A. They were kept by different parties.

A. I kept them for a portion of the time.

A. I don't remember the exact time. I had assistance at various times.

Q. 123 For how long a period of time did you keep them?

A. Several years.

Q. 124 Can you state between what years or between what dates you kept them?

A. A large portion of the time from the time the incorporation was made to 1873.

Q. 125 Who were your assistants in keeping those books?

A. The first assistant I had was Mr. Ralph Smith.

Q. 126 Who was the next?

A. Mr. James Moore, I think, was the next one.

A. Mr. John Miller.

A. What kind of entries?

Q. 130 Original entries of moneys or assets of any kind received from the Central Pacific Railroad Company, or from any person for that Company.

A. Anything that would be received in my absence would be entered by my assistants.

Q. 131 You say, then, that, during the time that you were secretary, there were other persons receiving those assets?

A. If any were received during my absence they would be received by my assistants.

Q. 132 Were any such receipts had, during the term of your secretaryship, during your absence?

A. Very likely. I was sick, or absent for other reasons, at times.

Q. 133 Will you state, from your best recollection, whether such was or was not the fact: that any such assets were received during any absence of yours?
